Re: Emancipation in New Jersey
My name is Kelli I'm 15 years old and would like some advice on how to emancipate myself. I'm living with my dad who has custody of me because he lied to the courts. I need help... I need to get out because he abuses me terribly and I can't live like this anymore. I've been trying to research emancipation and decided to get some legal advice. If someone could please help me because I can't live with his abuse anymore and my only hope is to get away from him before he hurts me again. Please help me or email me. I'll probably need an attorney so if you any good ones in NJ please tell me.

Re: Emancipation in New Jersey
You cannot be emancipated (see Aaron's post) if your being abused file a CPS report or talk to a school counselor, Cop, Doctor etc all are mandated by law to report abuse

If I have already told the cops and DYFS plenty of times but they don't believe me because they believe my dad over me what should I do? He does abuse me but my dad is a very powerful man and gets people to believe him over me or he just pays them off... then what should I do? Thanks for trying to help me. I just don't know what to do. I need to get out somehow... do you know of anyway? Please please help me.

I am currently 14 and living in New Jersey. I really want to know what age i can move out at. I hate living with my parents. They don't let me go out as much as I want and they are way too concerned about my saftey. If anyone knows the earliest age i can move out at with all the procedures please tell me. Also any other possibilties I can take in order to get what I want. Thanks[/code]
You are 14 years old. Are you serious? Most teenagers don't like parental authority. Being emancipated means having a way to support yourself (an apartment, utilities, food, etc). You are not even old enough to work (in most jobs). How could you support yourself (not living with someone). You want to move out because you cannot have your way? Welcome to real life. And welcome to the beginning of adulthood. There are going to be THOUSANDS of times you do not get what you want. At 14, your parents have a responsibility to you, even if you can't see it now. That means rules (curfew, etc). And in case you haven't watched the news lately.... kids your age are disappearing (and turning up dead) way too much. You have plenty of time to be an adult (trust me, when you are an adult, you WILL wish you were a kid again).
Re: New Jersey Emancipation
A fifteen year old cannot be emancipated. End of discussion. The law simply does not permit a 15 year old to be emancipated, regardless of circumstances.
If you are being physically abused call CPS. Or is there a teacher, counselor, pastor, or other trusted adult you can talk to?

Where is your mother?
My mother is currently trying to get custody back of me... but it's not going anywhere right now so I'm trying to figure a way out on my own instead of leaving it in attorney's hands who haven't done anything to help me. I do see my mom but I live with my dad... he has custody of me. If you know of anyway for me to get out besides emancipation because now I know I can't do that please tell me. Thanks

Re: Emancipation in New Jersey
I know I have posted several things on here already but if NJ has no emancipation stature then how do kids get out? If they are being abused and nothing is being done is there any other way to get out besides emancipation? One more question can a child request to be put into foster care? because I'd rather go to foster care and be put in the system then live with my dad? If anyone knows of any other ways besides emancipation for a child to be free from their parent please tell me. Thanks

Re: Emancipation in New Jersey
You have gotten your answer many times. If your being abused then you or a teacher, Doctor, counelor etc needs to file an abuse report
