    Probation Violation Due to Unpaid Restitution
    Hello I was sentenced to probation in september of last year 2006 for petit larceny. I was convicted of taking roughly $5000 from my last employer in forged timesheets. My probation stated that I was to pay 151$ month full restituion and 3 years probation. Now my goal was and still is to pay off all the restituion before the 3 years is up. But from the time I was sentenced I havent been working so I havent had the money to pay the restituion. I am a central sterile technician i hav been doin this for the last 4 years basicallyworkin i nthe hospital off and on. Now I have paid 800$ of the restituion so far, but as of right now I owe about another 860$ towards my restituion to keep me i guess on the right path. But since I have paid that other as of yet and I'm behind in my payments my p.o. violated me and i have a court date the end of july.

    I think its unfair that she violated me when it hasnt even been a year of probation yet I hav no prior criminal record and I havent been working but i still managed to pay what i could. I have been offered many different jobs outside of ny where my probation is but i have turned them down because they are "travel positions" example (travel nurses etc) cause my job fields allows me to do so, and as I stated to her if my probation was transferred to another state i would be able to pay my restitution. Because I wouldnt have to turn down these jobs.

    My question is what are my options, what do you think will happen to me on my court date july 31, and what is your advice? Also I have a new job offer to start monday july 2 but its in maryland....and I know if i take this job i will be able to pay or at least catch up to my payments before my court date...what is your advice and what do u think will happen??

    You don't have a good excuse for not paying off your restitution. It would make sense for you to pay it off now, even if you have to borrow the money.
