    Victim Of False Assault Charge
    I am the so-called victim of a domestic violence case. What happened was my boyfriend and I had a disagreement about finances and the police were called about a domestic disturbance. When they showed up, I was crying and his hand was bleeding from where he had punched the glass out of his hutch. When they asked me if he hit me I said no, but they arrested him anyways. I was told he was being taken in on domestic violence/ assault charges. I have been trying to get these charges dropped from the beginning, but no one wants to listen. We are expecting our first child together and I have already gone into preterm labor. He is currently in jail because of violating his probation by getting into trouble with the law (assault charges). I need to get this resolved soon so we can finally be a family. Please help! Does anyone know what the state of Maine does in these situations?

    Ok let me get this straight hes on probation, hes violent (hit hutch and broke glass thus injuring himself) and you stil want to raise a child in same house?!:wallbang: I am sure of the legality but the assault may no thave to be directed at you! His violent actions may have been considerd dangerous not to mention his probation status. If I might ask what is he on probation for?

    He really isnt a violent person. Usually when he gets mad, he goes for walks until he has calmed down. I wouldnt let him leave bc I wanted to work things out and thought that if i let him leave, he would walk out for good. He said he hit the hutch bc he would never hit me. He is on probation from a case a year ago when he broke the glass in the door at a McDonalds because his co-workers locked him out. He was banging on it and didnt mean for it to break. The conditions for that case to be dropped were that he had to stay out of trouble with the law for a year, and he didnt. It was the false assault charges that put him on probation. I know that he is a good person, and that is why I am trying to get this all dropped. What can I legally do?

    He is not safe no matter what you think he has history of violence and you want a child in that house with him!?

    He needs to get a lawyer. He has two courts (the sentencing court from his prior charge, and the court in which he is presently charged with domestic violence) to convice - and the standard of proof for the prosecutor in a probation violation hearing is significantly lower than that in a new criminal case.

    Why did the police feel that he hit you?

    I was crying when they walked in and had alot of scratches and bruises. The scratches were from our 2 new kittens, and the bruises from a football game with my family. I know he would never physically hurt me. Emotionally.... thats another story.

    You can try selling that one to the prosecutor. True or not, the prosecutor is unlikely to believe you.
