    In Nov I was caught shoplifting. I was detained but no charges were made. I was given nothing to sign, no warning of any future correspondence and released. In fact, once over, the LP person was rather nonchalant and walked me out. Very pleasant. He explained that the store was changing owners in a month or so and if it had gone to court, he would have been required to be there and not compensated. That and I owed him a drink. Ha. He remains an aquaintance. My life was a mess at the time and everything I owned was in storage as I had lost my home and was going through a divorce. Therefore, the address on my driver’s license was invalid and I made sure to give them the address where I am currently. In Feb a random ‘restricted’ call came to my cell phone. I borrowed this phone from my friend. The caller explained that it was in regards to an incident at Macy’s, that they had sent me something to my address and it was returned. They had sent it to the address on the driver’s license. I reiterated my current address. They told me to expect something in a couple of weeks and if I had any questions to call them. Nothing EVER came. No additional phone calls, nothing. I contacted my new friend, the former LP guy and he said he wasn’t sure but it MIGHT be a civil demand letter. He said if I wanted to challenge it, he no longer worked for them. It is now the end of June. The owner of the cell phone (my friend) called to say that a law firm had left a message. The name of which and the return number were inaudible. I’m assuming it is regarding this matter as there is nothing else it could be. Macy’s isn’t even in this city any longer. They became Belk. I am moving out of state soon. I was forthright with my contact address and numbers at the time. I am sorry that my life was in such disarray and the confusion it may have caused. I don’t know what to do or to expect. Can someone advise me? Thanks in advance! I’ve never been involved in anything like this before.

    You need to get the name and number of this law firm right away. This Law firm can triple the charges for your non payment and get a judgement against you! Your LP friend may know name of Law Firm or may be able to get it for you. The longer you wait the worst it gets!

    It was never explained to me that I would recieve, what I understand from here, a civil demand letter. I realize that is not currently the problem. I gave all of my addresses and numbers correctly. When I recieved that call in Feb or so, she repeated it back to me correctly. I've not hid from these people. If it gets worse, because of this time line, I feel like they have some sort of responsibility for that, for lack of a better word. I don't feel like anyone is going to understanding about any of this, if I can get in touch with them because they don't have to be. Therefore all the added hostility and charges are going to be put on me. What is the statute of limitations on something like this? I'm concerned to say the least. I'm not going to be at this address much longer. I've been staying with my father, who is very sadly enduring amputation of his leg due to stroke and other medical problems. I've been taking care of him and seeking long term care for him. Having found that, he will no longer be living where he is. My belongings are still in storage and I have a lot to do to get my life back in order. I don't expect anyone to care much about this but it is the reason behind the fact that my address will change again. Needless to say, I can't afford for something I was unaware of to compound. Explaining this to them is daunting.

    Civil Demand is a "civil" issue ther eis no SOL leave a forwarding address or contact store and ask for number of their civil recovery service

    It wasn't easy but I've located the firm and contacted them. They repeated the correct address to me and claim to have sent several letters. Other mail reaches me just fine so I don't know what to think of what they are saying.
    All she was eager to do is set up a payment plan for the fine. The fine is insanely high $1500.00 +
    I asked why it was so high and she said something vauge about state mandated fines. I understand now that 'restitution' cannot include 'state mandated fines'. I was not charged in this incident. My right to contest was not explained by them. I want to do so. Contest that is. There is no video, no witnesses, nothing and I have yet to see a letter. Refusing to pay is one thing but in the event they suggest putting it on my credit, I will let them know I will take legal action. What contesting involves----I don't know. I'd like to do it the right way. Under the guide lines of my legal rights.

    They have the legal right to put a negative on your credit for not paying. The high amount is probably late charges. They said they sent several letters. You can fight and pay an Attorney another $1000.00 but its doubtful you can win. Their actions are within the law and I certain they have proof of previous attempts to contact. If you can find an Attorney that will meet with you for a free consultation that might help you gain the knowledge you seek
