Division of Premarital and Marital Property
State-Ca....I have been married 1 yr and 9 months. My husband and I have filed for divorce. I purchsed my propperty 6 yrs before we were married. He moved in and did not pay anything for 1 yr and 3 months. I refinanced my home and he signed a quitclaim deed. After I refinaned he started to pay $900.00 a month becase I put his car into my loan to pay it off. He purshased the car before we were married and I helped with the down payment and I am also a co-signer on the car. He has made 9 payments of $900.00 before our separation and filing of divorce. Is he entiled to half of my property? If not, how do I calculate what is owed to him. The car was paid through my house loan and I am still paying for this. Am I entiled to half the car or reimbursment for paying off the car? The house tiltle and loan are in my name only. The principle on the home had not been paid down. Only the interest.
Re: Division of Premarital and Marital Property
Property division issues can be complex, particularly with issues of commingling and the merger of debts and assets into the marital estate. If you and your spouse cannot agree to how to divide the marital estate, have your situation analyzed by your divorce lawyer.
