    Michigan 7411 Probation Violation - What Could Happen?
    I appologize for the long post.

    Back in January my boyfriend and I were pulled over by police for stopping too far into an intersection. I'm not sure exactly for what reason(I was so nervous), but the officer proceeded to pull my boyfriend out of the car and searched him. They found a homemade marijuana pipe and put him under arrest. After calling for backup, the officer then pulled me out of the car and searched me. He found an empty bullet with cocaine residue in it, so naturally I was arrested too. Further search of the car turned up large bag of marijuana(don't know the exact amount because I don't use it) and my boyfriend's pair of brass knuckles.

    Both of us were sentenced to 7411, however I was allowed immediate discharge(by paying all fines up front) because I have never even had a traffic violation in my life. My boyfriend had the additional weapons charge so he was not allowed the same privilage. I, for the most part, have been doing my best to stay off coke and finish college. My boyfriend has not been doing well at all. In fact, I think his cocaine problem has been worse since the trial. He has only done 2 random drops so far and failed both. He is also on probation in another city for vandalism. Later this week he has to go to court for the second failed drop. Does anyone know what could happen? How many times is he allowed to fail a drop?

    What I would also like to know is if there is any way a lawyer to contest any punishment for violations because the system did not provide treatment it promised? He was told he would be receiving mandatory drug counseling. After being bounced from one office to the next, the judge told him not to worry about counseling. This man is so depressed. His baby-momma is constantly stalking him, physically attacking the both of us. If he goes to jail, he will probably lose his house and this woman will use it as an excuse to terminate his rights. Getting drug counseling would be just the tip of the iceberg, but a step in the right direction nonetheless. If anyone can help or give advice, I would be so grateful.

    first, relax about the parental termination, espcecially should the mother be on welfare. The last thing Mi wants to do right now is do something that would cause them to spend money they could not recoup.

    as far as how many bad test are allowed. how about...none. with a bad test, he has violated probation and probation can be revoked and his original sentence can be imposed.

    counseling? didn;t they tell him it is wrong and he should stop? consider him counseled.

    honestly cannot think of anything good to tell you.

    In simple terms, he's not allowed to fail a drop. Given that he's on his way to court, it sounds like his probation officer is going to ask that he be determined to have violated his probation, and probably intends to recommend some jail time.

    You can't count on the system to provide you with counseling. AA and NA are free (but they're support groups, not treatment.) If he wants free treatment, he and his lawyer should check out Dawn Farm.
