Threatened With Wage Garnishment After Returning Leased Car
Today I received a Call from a Collection agency, regarding a car lease I return to the dealer because the car was 4,000 miles and started to leaking from the transmission badly. The collection agency told me that if I din't paid their money they were going to furnish my check from work, can they do that? I appreciate your advice on this matter, thank you.
I am in California.
Re: Threatened With Wage Garnishment After Returning Leased Car
I'm unfamiliar with California-specific law, but generally to garnish your wages, they would need to obtain a judgment from the court. threatening to garnish your wages without having obtained said judgment is a violation of the FDCPA, threatening to take legal action which cannot be taken.
