Age Of Consent For A Same-Sex Relationship
I am a 26 yr old gay male in Oklahoma. I have recently become involved with a 17 yr old gay male also in Oklahoma. His parents are extremely against him being gay. They have recently stating if I do not cut all contact including e-mails, pictures, text messages and phone calls that they will have me arrested. The age off concent in Oklahoma is 16. Do they have any actual legal grounds to be able to do anything to be for being envolved with him?

The age of consent in Oklahoma is 16. I can find no reference to a particular sex.

I believe that the statute which directly addressed gay relationships was held invalid, leaving only the general statute to regulate "age of consent".

I did a lot of research after his mother sent me an e-mail, and already discovered the age of concent is 16 in Oklahoma for all genders and relationships. Both of his parents are extremely homophobic so it does not surprise me that she sent me the e-mail. I am simply trying to settle my own nerves and determine if she has any legal standing to be able to do anything to me for any reason.

Of course she does! She is the PARENT of the minor child. Until this boy reaches his majority she has the right to decide who he has contact with. As a parent I too would have an issue with my 17 year old child dating a 26 year old. Same sex or not makes no difference...You are just to old to be dating a 17 year old.

I would also point out that you cannot send any sexually suggestive or racy messages, text, e-mails, etc, whether he has reached the age of consent, or not. He's still a minor until he is 18.

Mom has complete control over who her child may or may not associate with until the child is an adult.

And where can I find that law?

As I read that statute, I doubt it could be applied to a dating couple. It's clearly written to target sex offenders who use the Internet and related means to target minors.

Re: Age Of Consent For A Same-Sex Relationship
The statute says "any person"...not just potential child predators.

This is not a dating couple as the minor's parents have forbidden any contact. (as is their right, regardless of the legal issues or lack there of).

Even if the charges wouldn't stick, it could give the parents one more thing to cause problems for the OP.

He needs to be very careful.

Re: Age Of Consent For A Same-Sex Relationship
I was commenting on the language which comes after "any person". As for the parents wishes, they're quite beside the point as far as the statute is concerned. This isn't a stranger soliciting minors on the Internet, the plainly intended target of this statute. If you have any case law or other authority, such as an Attorney General's opinion, sharing your maximally expansive interpretation of the statute, it would be helpful to review it.

Actually, from his post, it is impossible to tell if the OP has ever actually met the potential boyfriend in any form OTHER than electronic means.

If that's the case then I agree with you, the statute would seem applicable.

    ok
#1 the e-mail's that I mentioned were simply correspondance with no sexual undertone either implied or explicit. I sent one picture to him which was an edited verision of a full body pic in which my genetals were blacked out and could not be seen.

#2 I am simply trying to determine that if innocent contact such as non sexual phone calls, text messages etc are continued does she have any legal standing that I would need to worry about. I am NOT refering to weither or not she can simply tell him not to talk to me and we continue.

#3 Would she have any legal standing that I would need to worry about from us meeting in person? Based on all info I have found, due to the fact that he is above the age of concent in Oklahoma but under 18, she has no legal standing. I am just trying to confirm that.

I am simply trying to make sure we are not breaking any laws that are punishable legally NOT morally or parently.:wallbang:

Did i really read about his parents being homophobic.

Of course this is the thing which the parents should contact:
    PFLAG National Office

    1726 M Street, NW, Suite 400

    Washington, D.C. 20036

    Main Phone: 202.467.8180

    Fax: 202.467.8194

    General: info@pflag.org

Because originally my mom disliked me for being queer but after reading their stuff she supports me. :)

Yes his parents are extremely homophobic due to their religious beliefs. His father has said on more than one occasion that he would disown him if he found out he was gay. His mother told him he would be going to a shelter and she would probably just die.

It seems that many Religious people are also hypocrites, no i'm not putting all religious people down, because there is a excellent group called Dignity USA.

Because i bet that they eat shellfish, and i wonder being left-handed because i do a lot of things left handed like play a lute.

Because it states in Lev. that eating shellfish is a sin.

Re: Age Of Consent For A Same-Sex Relationship
Asher, so you have not met this minor in person?

You sent a nude picture of yourself with the genitals blacked out? (that's pretty overt, by the way).

If this is the case, please refer to my original post.

You contacted a minor and sent a nude, full body shot (with twig and berries covered).

At this point, the homophobia is irrelevant. For that matter, you don't know for a fact that his parents ever said anything of the kind. How would you know? You've never actually met these people. The fact is that his parents may have a fear of grown men contacting their child and sending nude photos to their son. :wallbang:

Yes we have met in person we went on a date about a month ago. No sexual activity has taken place as of yet. The picture was not simply my "twig and berries" covered. I appeared as though I had underwear on due to me editing out that section of the picture by drawing a black box from my waist to the top of my thighs, kinda like they do on TV. I have no doubt that his parents said it especially considering the fact that he and I still talk regularly over the phone, and have planned another date in the near future.
