re-entry to US with a misdemeanor bench warrant
I was in the US in 2001 to 2006 and I overstayed my visa and I got arrested by ICE officers and detained in custody. Before that I was married to my wife US citizen. So the immigration judge granted me voluntary departure. And me and my wife are in my country now applied for immigrant visa and because I overstayed we applied for a waiver and got approved My criminal action didnt make me inadmissible bc I was under the age of 18 and it was a minor charge. so ı have my immigrant visa now but I was on probation in new york for that youthful offender minor charge and my Probation officer told me that I have a warrant for me leaving the country even though I had to leave by INS. he aldo said that if I see the judge the judge will not sentence me again and give me the probation again. so because I had to leave its not a violation of probation.
My question is will ı be arrested at the airport or they wont see the warrant. or do you think I should fly into different state. I will take care of the probation as soon as I get back to NY, I just dont wanna get arrested at the airport and refused entry. Thank you
Re: re-entry to US with a misdemeanor bench warrant
I can't predict what might be detected at the border. In today's era, it is sensible to assume that a warrant would be detected. I suspect that you would be permitted to enter, particularly as if the USCIS has already granted you a waiver they should have already investigated the matter.
