Who Gets The House?

I need some help her. My wife and i have been married for 8 years now. To much has gone on and she wants out. We have (3) kids (1) of them from are hers from somebody else. We bought a house and due to my wifes poor creidt she was not able to be on the loan and was left out of the tile. We ran into some $$ issues and was going to lose the house. My father stepped in and bought the house from me and now we pay rent. Only my name is on the title with my dad. I was not even able to be on the loan due to my creidt. Does she have any rights to the house???

sorry about that yes it is in Indiana. Also to add to this i solely supported the household until just a year ago.

The house was bought the first time for FMV. But we got into taking on a 2nd and line of credit and then got way behind on the payments and it was going into forclosure. I got the banks to forgive some of the debt and then my Dad had to put down about 14,000.00 to get the loan in his name. This was the only way due to the house value was way under what was owned.

I can provide the relevant Chapter of the Indiana Code, but that is all I can provide.

I quess what i am wondering is if that she does not want the house do i have to buy her out?

What do you mean about Dad getting the loan in his name?

Did he loan you money?

Did he put a mortgage on your place?

Did you and your wife deed an interest to him?

Typically, where one spouse doesn't want a marital property and the other wishes to retain it, the one who wants to keep the property agrees to buy out the other spouse's interest.
