My 18-Year-Old Daughter Is Dating A Minor
My daughter will be 18 the end of June. She is dating a 15 year old. He will turn 16 the end of October. He is a nice boy, but I found out that things are getting heated, but no sex yet. We all live in Florida and I wanted to know if they do decide to have sex can she run into a legal situation if his parents were to find out? I have always promoted the idea of waiting until you are married, but I'm also realistic.
Now if it is not legal and let's say the parents decided to charge. If he was coming to my home, can that implicate me as well as her mother? I have two younger children and I will not risk losing them because of her decision of having a younger boyfriend.
Also if there is no sex involved, but other acts, does this implicate her as well? Any information offered would be so helpful.
Thank you. This mom is very worried about her daughter's future.
P.S. We thought of creating a contract that his parents consent to this relationship. Would this protect her if they sign it?

You cannot consent to an illegal act! Until the 15 year old turns 16 he is not age of consent if they have sex or engage in sexual acts. By the way why would they tell the truth if they are having sex or engaging in sex acts!? I am not saying they are liars just making a point.

See this is what is confusing me because I've been reading on other sites that the consent age would be 18. That is why I am so confused.

Thats still no gurantee I hope it correct but we must not assume! Age of consent in Florida is 16. That does not mean she would be in the clear but it is a legal arguement in her favor

Well I need to find a definate answer as I have two younger children and I do not want to be involved if there is a chance of her getting into a mess for dating a younger person. So once she turns 18, you are saying that for her not to deal with any legal ramifications, it's best she waits until he's 16? But then on the other hand you are still implying that she can still find herself dealing with legal issues if the parents decided to step in?

If the minors parents object to the relationship they can order them to stop. If they do not they can (although very difficult) get a protective order. If they have engaged in sex acts (although not intercourse) she could be charged. You have no gurantee they havent!

I hope you don't mind all the questions. I just want to be very clear that I understand this.
So when he turns 16, it really doesn't matter? If the parents object they can cause my daughter legal problems?

The AOC in Florida is 16, BUT...for an adult 24 or older his/her partner would have to be 18.
Your daughter has already committed a crime by engaging in ANY sexual activity with this child. She is an adult and should not be having sexual relation with a boy of 15. Search this forum and see what others that have made this mistake are going through, and show your daughter...there is a thread on here right now about a girl that has to Register as a Sex Offender for her behavior with a minor. This is a very serious issue that could screw up her future...I suggest you take your daughter to an attorney and let him/her fill your daughter in on the legal ramifications of her actions.

She's not an adult yet. She will be 18 the end of this month. That is why I'm trying to gather as much information to show her. He will turn 16 end of October so that is why I am posting here, to find out what she is up against and to find out if I would be held responsible since she lives with me.

Your daughter is OVER the AOC, her BF is UNDER the AOC. YOUR DAUGHTER is committing a crime by have ANY SEXUAL CONTACT with this boy.
And the crime doesn't disappear when her turns 16. She could still face charges for her action for years to come. If there are e-mails with sexual discussions...those are potentially a whole different set of charges...and they are proof of her crime/s.
Please take her to talk to a Criminal Defense Attorney and have him/her explain what she is doing wrong and the consequences she faces by her behavior.
You seem to be looking for a way to get around the law...that is not in your daughters best interest. If she is still a minor you need to assert yourself and TELL her there will be no more contact between her and the child. When she is 18 and living on her own at that time she can flush her future away by having relations with a legal child.

I'm not trying to find a way around this. I really want to understand this and you have made it very clear and thank you for that. I just want to gather as much information so that I can present it to her. That is why I wanted to also find out that if this relationship were to continue, if I could find myself in a legal situation as well. She started dating this boy a couple of months ago and I told her that I was not in agreement of this relationship because of the age difference. I should have stopped it then and I know this now. I was hoping it wasn't going to last but the obvious is that she will become an adult and I personally don't want any problems for myself since I have two other children to raise.

I'm going to have her read this and will look into an attorney.
So if she continues seeing him behind my back, but is living with me. Can I be held responsible?
Also if I tell her he's not allowed to come here because of this and I know she's going to be with him because her parents pick her up here, will I still be held responsible?

Your the parent you make the rules! If you forbid her to see him then thats the way it is until she reaches age of majority! Even then if she lives under your roof you stil make rules! Yes you should have stopped this long ago but you still can. She may hate you now but later she will thank you. She will be moving on to adult things and lifestyle he will still be in High School. either this will force him to grow up too soon or hold her growth back. If its real then it will still be there in a couple years. If you allow the relationship to continue and they have or do engage in sex in your home you yourself could be in trouble along with her.

You a right. Now when I tell her that she can not be with him but when she turns 18, she still decides to see him (not at my home). Can I still be held accountable if I know she's still seeing him elsewhere?

No we haven't but they are very religious and don't think their son would do such a thing and don't see a problem. Our daughter has let him know how we feel and he has told his parents about it. They said they would sign something consenting to this relationship, but I also found out that this won't change a thing.

We have thought of sitting down with them, but seriously what kind of plan can we formulate other than ending the relationship? No matter what, until he turns 18, my daughter's future is at stake. They can tell me they won't persue any legal actions today, but there's no guarantees for tomorrow. True?
Now she can still persue a relationship on her own away from my home, but she will be the one taking that risk.

Did i read that the other family is Christian?
Well can you call them hypocrites if they don't forgive,because one the the most important teachings of Christianity is to "Turn the other cheek" and "To forgive and forget" Because if they don't follow that part of the bible then i would call them hypocrites and accuse them of "cherry-picking" the bible if i was put in that situation.

Well we just sat down with her and discussed everything that I've learned here. She is really crushed and not sure what she is thinking, because she does not want to talk about it. She does want to see a Criminal Lawyer and hear it from him/her. So off I got to find someone in our area.
Even though it kills me to see her hurting, I know this is best. One day when she has her own child, she'll realize where we are coming from.

(a) Engages in sexual activity with a person 12 years of age or older but less than 16 years of age; or
(b) Encourages, forces, or entices any person less than 16 years of age to engage in sadomasochistic abuse, sexual bestiality, prostitution, or any other act involving sexual activity
commits lewd or lascivious battery, a felony of the second degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
(5) LEWD OR LASCIVIOUS MOLESTATION.--
(a) A person who intentionally touches in a lewd or lascivious manner the breasts, genitals, genital area, or buttocks, or the clothing covering them, of a person less than 16 years of age, or forces or entices a person under 16 years of age to so touch the perpetrator, commits lewd or lascivious molestation.
(b) An offender 18 years of age or older who commits lewd or lascivious molestation against a victim less than 12 years of age commits a life felony, punishable as provided in s. 775.082(3)(a)4.
(c)1. An offender less than 18 years of age who commits lewd or lascivious molestation against a victim less than 12 years of age; or
2. An offender 18 years of age or older who commits lewd or lascivious molestation against a victim 12 years of age or older but less than 16 years of age

Some news for you all!
We went to a highly recommended Criminal Attorney. He can be with her when he turns 16. Th AOC here in Florida is 16 if she is under 24. So I suggest some of you do some reading, because it used to be 18. That's why it was very confusing to me. Now the attorney did say that when she turns 18, she can not be with him until he turns 16, if she gets caught then she is facing a felony charge. So we made it very clear that she is not to have contact with him until then and if their love for each other is strong enough, then their relationship can go forward once he 16.

Reading the different posts here confused me because I was not getting a definite answer. I felt that even when he turned 16 she could still encounter problems.
But it doesn't matter, because now I understand clearly and hopefully my daughter understands as well. Hopefully she won't be stupid and see him behind my back.

I was not the only person confused by the information given here. I had my husband read it and a close friend and we were all still unsure, because we kept feeling that there was still a chance she could get into some trouble even if she waited for him when he turned 16.
Some of you here may have a lot of legal knowledge, but some of don't and may not understand clearly all the terms. But I am very thankful for all the posts made here and advice.
Hopefully another parent like me that is not very knowledgable, may find this thread helpful.

She can still get into trouble for sexual acts she committed BEFORE he turns 16, AFTER he turns 16. Because he turns 16 does not erase any crimes she committed against him before he reached the AOC. I hope this is clear to you.

Is it just me or am I the only one just a tad bit concerned with the fact that daughter is so immature that she is unable to have a relationship with an ADULT HER AGE? At 18, the last thing I wanted to do is run around with someone who just got into high school. Maybe it's just me....but something is just weird about that all.

I was saying the same thing to Ohiogal....At 18 I wouldn't even date 18 year old guys...I thought they were dorks!
Perhaps OP's daughter is a little slow or socially immature.
