Bankruptcy Lawyer Didn't File All Required Documents With The Court
I am so frusterated, I just don't know what to do.
I met with and paid my lawyer in January to file for Chapter 7. I gave him all of the documents he needed. Come March, he still had not filed my case! He gave an excuse about losing the company credit card so he couldn't file, etc etc. (it sounded suspicious to me) After about 15 phone calls and me going there in person twice, he finally filed it. He gave us a call the next day that he now needed my payroll stubs and also my husband's.
We brought them to him same day. He said that he would submit them. I thought that everything was good.
Fast forward to June 2nd. I get a letter in the mail from the court saying that payroll documents were not submitted and that I must present them at a hearing on June 13th and they will decide if my case will be dismissed or if it can still be filed.
The problem: I just graduated in May, and I found a job that pays more than my past job. We are finally getting to be financially stable and rebuild our finances. We now make just over the limit for filing bankruptcy.
I am so afraid that I won't be able to file and that a judgement will be ordered on me from the creditor since the accounts as soooo past due since I thought the lawyer had filed. :wallbang:

Get a new lawyer. If you cannot qualify for Chapter 7 because of the delay, consult a legal malpractice attorney about whether you have a case against your first lawyer.
