Taking Non-Father's Name Off Of The Birth Certificate In Texas

I am located in Texas.. My stepdaughter and her boyfriend were together and split up for a short time. In that time she was with another person.. she and her boyfriend then got back together.. long story short she got pregnant and didnt know who the dad was.. our grandbaby was born and it was evident that the boyfriend wasnt the father (the bio dad is of another race).. he was put as the father on the birth certificate and got highly offended when the nurse asked if he wanted a paternity test.. he signed the certificate as the dad.. stepdaughter went and talked to the bio dad but he didnt want anything to do with the baby and ended up quitting his job and noone knows where he is..

Stepdaughter and her boyfriend are calling it quits.. the question is now how can she get his name taken off as the dad on the birth certificate.. I personally dont know if he wants to be taken off but she wants him off as she wants nothing further from him and also how can she change the babys last name to hers rather than the boyfriend who isnt the dad.


Sorry about the questions.. I feel like this is a soap opera scene gone bad.. Just trying to help her answer some of her questions..

Does he want to be removed as the father?

If the child is more than 4 years old and the boyfriend has established a relationship with the child, it may be difficult to rescind his acknowledgment of paternity without his full cooperation.

If they were never married, and no child support or paternity order is in place, she can probably do it. Does she intend to seek child support from either man? I suggest she hire an attorney to file a suit to disestablish paternity with boyfriend and establish paternity with bio dad. That can result in an amendment to the birth certificate and a child support order.

the baby is 11 months old.. she has no clue where the bio dad is at this point..

the ex boyfriend hasnt said anything about being taken off of the birth certficiate but personally I dont think its right to leave him on there as the state will go after him for child support for a child that isnt his..

I have instructed her to find an attorney..
