Colorado Emancipation Law
Im fourteen right now, but i will be fifteen in January. I live in colorado with my father right now, and i feel like this time between the two of us- has has long enough to boil. In other words i can't stand living with him. I used to live with my mom, back in Utah. Which is where my goal is to return to. Sadly my mom was caught for substance abuse, so i was removed from the home. First things ya'all should know is, i do not wish to return to live with my mom, only Moab. I have tried other ways to return other than resigning to this thought. I just want to know if it would be possible for me to file for emancipation once i turn fifteen. Is there anybody in Colorado who has done this? :? Is this a good idea? Should i try something else? I just don't know what im gonna do, i just need to get out of here!
Colorado Emancipation Law
Colorado does not appear to have a statutorily defined procedure for emancipation. It recognizes emancipation in its statutes:
Quote:
Quoting Colorado Code 19-1-103. Definitions
(45) "Emancipated juvenile", as used in section 19-2-511, means a juvenile over fifteen years of age and under eighteen years of age who has, with the real or apparent assent of the juvenile's parents, demonstrated independence from the juvenile's parents in matters of care, custody, and earnings. The term may include, but shall not be limited to, any such juvenile who has the sole responsibility for the juvenile's own support, who is married, or who is in the military.
In order to qualify as emancipated under that statute, at a minimum you would have to be at least fifteen years old and living independently of your parents. That would likely be difficult to achieve unless your father consents.
