Son's Name Change in California
Hello. My son is 11 yrs old and I'm going to change his last name to my husband's last name. He has been his father for 10 yrs. I have filed a petition in the county of Los Angeles for name change of a minor. But I have a few questions. I have published with the newspaper. For the proof of service, do I have to file this before my court date? Does the bio-father have to sign something. He says he will sign whatever he needs to sign but he will not go the court hearing. He says he doesn't have time. What happen if he doesn't have time. He has not been involved in my son's life since he was 6 months. No child support. My son doesn't even know him he has never seen him. Can anyone help please?

I would file proof of service in advance of the court hearing. Take all required documentation with you to the hearing. If the father wants to execute a document, ideally notarized, indicating his consent to the name change, you can take that with you as well and see if the court wishes to review it.
