    Security Guard Arrested for Battery
    I live in Georgia. Here's the situation... A nightclub security guard breaks up a fight among three people inside the establishment. He physically (by pushing) removes them outside of the club to where an off duty officer working part time for the establishment is. The officer restrains one of the individuals while verbally commanding another to sit in front of the patrol car. The third aggressor supposedly swings at the security guard.. he was able to defend and counter then the individual sitting at the patrol car joins in.. he is also subdued by security guard. The outcome: security guard is arrested for simple battery on the first aggressor not the second. When interviewed, security guard states that while breaking up the fight inside the club he was punched (have pictures) and his finger was jammed by someone grabbing it when he directed them to leave (finger pointing). Also there is video tape of the individuals fighting each other inside the club. My question is can the security guard pursue battery charges based on the fight inside? And why would he be arrested since it was established these people were fighting and non compliant? Also during the fight inside some items were broken.. can the establishment file some complaint for damage to property (said items equal about $50 but its the point)? By the way I am none of the parties involved.. I'm the owner. Any points of view would be greatly appreciated. Thanks

    The security guard can make whatever report he wishes to make about the incident, to see if the police will prosecute anybody for assaulting him. The most important issue for him, though, is the criminal charge that was filed against him.

    There will be a police report from the incident and, if you read it, it will probably explain why the police arrested the security guard and not the other individuals.

    If you wish to make a small claims complaint against the people who damaged your property, you certainly may do so. If they are prosecuted you may be able to make a claim for restitution instead of suing them.
