First Degree Criminal Trespass in Colorado

My ex-boyfriend followed me home last night while I was walking home from the bar. I had a girlfriend with me and he was harassing us both the entire time. When I was unlocking my apartment he forced his way in and was screaming at us, calling us nasty names and stuff. I probably asked him to leave 30 times, when he finally did I called the police. They found him 20 minutes later so drunk he could barely stand and asleep in the backseat of his car. They have charged him with first degree criminal trespass. He has had some prior tickets, he has had two DUI's and failed some drug tests while on probation. I was told by the officers that first degree criminal trespass is a felony. I'm just wondering what kind of punishment he could get . . . I mean, could he serve jail time??? Felonies are pretty serious . . .

presumptive penelties from Colorado statutes;
class 5 felony:
One year imprisonment to Three years imprisonment . Two years mandatory probation.
if he has no other felonies, it sounds like the prison time is discretionary. If he has had felonies, things get more serious and definate.
the folowing fines can be in addition to or in lieu of imprisonment. Judges discretion I believe;
class 5 felony
One thousand dollars up to One hundred thousand dollars
yep, definately sounds like it could be serious.
also sounds like you are feeling guilty.
You need to think of the consequences before you act. If you didn;t want him arrested, you shouldn;t have called the police, but then you would be complaining he beat you up or some such action.
He screwed up and will now face the consequences. Maybe it will help him in the long run.
