    Caught Shoplifting But Not Arrested - What To Do Now
    i was detained for shoplifting about a month ago by LP, cops were not called but they made me sign a trespassing paper and another paper starting the dollar value of the merchandise and a pic of my DL, the merchandise and me. they said i would be getting a letter in the mail with a fine, in 7-10 days, which i received almost a month later. The paper with the fine says i have another month to pay it and said that this is in addition to any fine from criminal charges or any criminal prosecution, which i didnt recieve anything from...the paper also says that the store does not have any control over criminal prosecution.

    my question is, are there still going to be criminal charges pressed against me even thought i didnt get a court date or anything in the mail yet...and...what are the chances of me getting criminally prosecuted since its already a month+ since the incident. also there was another letter with the letter stating the fine that says some code-like number and some law regarding shoplifting with it.....is that something that they send everyone or only people that are going to get prosecuted later?

    The letter you got was pretty much a form letter it covers everything. As you have been told the likihood of prosecution at this point is almost zero. Pay your Civil Demand and this should be over. If your that concerned contact PD or courts and ask if store file charges but I can tell you its not likely, the store has nothing to gain by pressing charges once you pay Civil Demand

    since the police were not called and as far as i know, i am not being prosecuted,this wont go in my criminal record....right?

    also IF the store presses charges after i pay the fine, will the paying of my fine mean that i would be admiting that i am guilty?

    No it means nothing that fine would tak eplace even if you were being prosecuted

    even if there isnt a criminal record, i think that employers or anyone that does a background check caz still find my name is other databases and know about the incident.....so if thats true i wanted to know that if an employer does the background check in the private database...how much info can they get...is it just my name and ssn that comes up...or can they have acess to stuff like date/$amount of merch/what store/how much the civil demand fine was/any other info...so basically how detailed reports from private data bases are?

    A typical background check will come up nothing! Now if possible employer access database your name "might" be in thats differnt or if they spend extra monies to do a more through background and thats very

    i think the store this happened has uses choicepoint....so if another employer put my name in that database...how detailed of a report might they get

    also do you know of when stores are hiring people they put employees names into a database like choicepoint or they just do a normal criminal background check, in which case i should be clear..right?

    Where its impossible to say what anyone will do I will say you worry too much. What type of job are you seeking that you feel they will spend the extra money for further background checks?

    its a job w the university i go to.....

    i think i have something confused tho....is doing a criminal background check different from having someone search ur name in a database like choice point?

    because i heard that in databases like choicepoint, employers could put ur name in and get details about incidents even if they were not criminally prosecuted...

    A criminal background will come up zero because at this point no criminal charges have been filed. Far as database its likely a database for retailers or even just for the retailer you stole from.
