    What are the chances of the courts allowing the move?
    I want to move to my daughters to Colorado with me but I need the courts ok. When requesting the modification what is the best approch?
    There are several factors to our moving, Better pay, better cost of living which means a better possiblility of buying a home, sending my oldest daughter to college and being able to survive and supporting my children comfortably. We have family support there which has been difficult being away from since the loss of our father in Feb 05.

    The ex has continued to harrass me using our daughter to have the "right". He continues to involve himself in my personal buisness, asking for information to use against me verbally, trying to destroy my self esteem. He has been married 6 times and continues to have one relationship after another in the presence of his daughter (6 yrs old). I have asked that he restrain while she visits on the weekends but he won't. He sleeps with them, uses them with my daughter in tow and then goes to church with ex wife number 5. My daughter seems to be afraid of him, telling me secrets and telling me "don't tell daddy". She needs a safe place to go and I keep her secrets, NOW. When I did address my concerns with her dad, he would do or say things to her to make sure she didn't make that mistake again and she would become withdrawn. The courts are more concerned with the "fathers rights" they over look the childs well being. When I voiced my concerns to the courts/mediation, the ex told them I was mad/jealous because he has a new relationship and was resentful he wouldn't take me back and they believed him, even tho I filed for the divorce. If I use these reasons as part of want to leave they will think I want to sever the father daughter relationship.

    PLEASE TELL ME THE BEST APPROCH TO LEAVING FOR CALIFORNIA AND BEGINNING A NEW LIFE. THANK YOU!

    Given the history of the case you describe, your ex's opposition to any move, and the probability that your petition will thus be both complicated and opposed, I suggest you consult a local child custody lawyer for assistance.
