    What Are The Chances That Charges Won't Be Filed
    1st time offense, 10 dollar item, cop was at the store, held me for questions and took a copy of my license and said that I would be getting a court order in the mail in 30 days - that was it.

    I know it is likely that I will, but is there even a possibility that I won't have to go to court because of the amount and because I don't have anything else on my record? I don't want a prediction because I know that's impossible, but does that ever happen even when a police man (or woman) is involved where they say it is going to court but the DA decides not to press charges on a first time offense and it just sits in a file or something?

    I am sorry but the "Expert Law" crystal ball is out for repairs so we will be unable to answer your questin right now. Ok all kidding aside we cannot predict what will or will not happen far as charges go. Suffice it to say if store is pressing charges then yes you will see court

    Thanks Kreskin:) But seriously, since it was a cop involved, does it matter if the store presses charges or not? Can he just bring me to court anyway? And also, if the store was going to press charges, why wouldn't they have me sign something just for extra proof/to put in their records?

    The DA has the "option" to drop case and not pursue it. Yes your right its a small amount but no one can say what DA will do.

    I know - I have no idea what the DA will do, I was just wondering if it's even a possibility - if that has ever happened (it's filed because the amt. is small/no other charged).

    Your asking for questions that have no answers is it possible yes. Now will that change your situation? No it wont. Talk with a criminal defense Attorney and ask about diversion

    I have another question - I have a relative who is a police officer in another state - he said that the person who flashed a badge and detained me is probably an LP person/store detective and not a cop. If it was not a cop (it all happened so fast I'm not really sure) could he have still arrested me (because he said he was choosing not to, that I got lucky, etc.) and can he still file charges if not an actual police officer (said he is filing charges)? I'm confused - please clarify.

    A Loss Prevention Officer has same powers of arrest you do as a citizen! He can choose to arrest or not arrest. However the choice to prosecute comes from their store policy

    Yes have your lawyer request their LP manual and trainning records
