Uk Mentor Charges My Credit Card After Canceling
My question involves criminal law for the state of: NY and oversee UK?
I own a staffing business in NY and I've hired a coach [Nov 11th 2019] to mentor me from the UK. There are reoccurring automatic credit card charges. I was under the impression that I can cancel within 100 days and get a full refund if this doesnt work out. I've chose to exercise that right and emailed to cancel [Dec 10th 2019] and ask for a full refund. In turn, he said I had to "Stay" for 100 days and do everything he's asked to be entitled for any refunds. I was charged again on Dec 13th 2019.
Currently, in a dispute with merchant through credit card company who seems to be favoring the UK merchant because they are not reading my actual letters. They think I'm disputing ALL the charges but I'm only disputing the last charge after my email to cancel. The confusion lies in the wording of my email asking for a full refund and the UK merchant has provided the contract that I've signed that no refund is entitle unless I complete 100 days.
I'm looking for the general terms to put in my letter to the Credit card company. What I've gather so far is:
- They didnt provide a cancelation policy
- No easy way to stop recurring payment
- This is an unauthorized charge
Anything else I can say as a legal defense?
Re: Uk Mentor Charges My Credit Card After Canceling
I've been in the staffing business for 20 years. Unless you are trying to open a staffing business in the UK I can't think of a single thing you can gain by hiring a mentor in the UK.
That said, you have done the first thing right. You have disputed the charges through your CC company. Now you need to find someone at the CC company to understand that you are only refuting certain charges.
You should also confirm with the CC company that no future charges from the mentor are authorized. You need to do that in writing.
Do you have a contract with the mentor?
Re: Uk Mentor Charges My Credit Card After Canceling
Yea...I know..dumb mistake. We had a video meet and I was under the impression there is no risk because I can get a full refund within a 100 days.
I've ask CC Company to block any additional charges from that merchant.
Here is the contract we signed:

I've spoken to him after I emailed him to cancel....I have to do Everything he says for 100 days or there is NO refund. His justification is that if I don't follow the program..how will it work?

£1700/month so about $2700 a month...very costly mistake. The payment in dispute is about $2300
So back to my original question...What are the legal defenses for this?

That there was no binding contract would be one place to start. That said, I doubt the UK based business will actually sue you in the US.

I did sign that contract, would that make a difference? I'm not worried about getting sued by him. just trying to get the last credit charge after cancellation.
