My question involves criminal law for the state of: va
1. Don't shoplift.
2. Stay out of the stores in which you've previously shoplifted.

Most of the General District Courts that handle shoplifting cases offer some sort of first offender diversion for shoplifting that may allow you to avoid a conviction.
In addition to your criminal problems, you can expect that many of the chain stores' "lawyers" will send you a separate civil demand.
And no, the judge is not going to believe you when you say:
1.) I forgot I put it in my pocket/bag/purse for easy carrying
2.) My child put it on the bottom of the cart and I never saw it or knew it was there
3.) I just went outside to answer a call on my cell when I couldn't get a strong signal in the store
4.) Someone else I was shopping with put it in my bag without my knowledge - s/he was the real shoplifter and I'm an innocent victim
5.) Etc.
