Misdemeanor Welfare Fraud
Hello, I live in CA. Back in 2005 the welfare dep. found out that I was working and receiving cash aid and some food stamps. I have a 10 year old that does receive child support, well the whole deal its that I thought that move was for him because human services made me file for child support, even when I didn't want anything to do with my x, that was the only way that I could be helped, so I file, and I stated to recice the cash an fs, later I got a job, and evryfew months I would receive like a report and since I thought it was nothing I just sign it and send it to my case worker. I was pregnant at the time, so later I had my baby I wanted to enroll her in medical sot thats when she ask if I was working and said yeah but i am on maternity leave, so she reported that and I told her that I thought that was for my son, even tho I explain my situation the also was pregnant, working full time, have personal problems, plus high blood pressure when I was pregnant nothins was good enought excuse fo them. Never got arrested, but whent to court, then got 3 years probation, restitution, a $400 fine, for me it is a misdeminor.
Now that I looking for a job I feel like I am being discriminated, I went thought an interview, the lady like me told to sign a paper for a background check plus a phisical, and proof of employment. So I pass the phisical, so I get proof of past emplayers, in the interview the lady ask me if there is anything that she needed to know about my criminal background I said yes I explain next day to offer me the possition, they put me thought a physical :wallbang: tb test, chest x-ray, and requirements, then the hr lady calls me and tell they found somethind and I was like yes I know I already told the manager the interviewed me , she told me we cant offerd you a job, so what can I do, I feel like the discriminated me, is there any laws that pray anything about this case, what can people do after the have something in there criminal record, we are not good enooght to better ourselfs.
Re: Misdeminor "Welfare Fraud"
state Ca. An employer has every right not to hire you if they develop something on a background check. You will just have to keep looking for work.

When you go for an interview and you seem like it is a good match you need to be upfront with your history. It will help establish an honest relationship with someone who is going to find out about your record.
Being poor is not a disgrace. If you are tempted to take money that is not yours and are caught, it is something that you will have to work through. By that I mean that you will need to prove your honesty before your prospective employer decides to hire you.
You are not being discriminated against. You need to re-establish yourself as a honest person that someone wants to employ.
