Ticket and Courtesy Notice Discrepancy in California
Just wondering if anyone can help out.
My father was cited for the following violations
22349(a)
4000(a)
6700
This is what is written on the yellow citation typically issued by CHP.
The courtesy notice that arrived later in the mail only lists
22349(a)
4000(a)
I called the courthouse to confirm what violations are listed on file and they only confirmed the two counts above.
Therefore, is my dad okay in ignoring VC6700 since the courthouse does not have that violation listed?
Thanks all.
Re: Ticket and Courtesy Notice Discrepancy in California
Yes. Chances are you will receive an amendment in the mail. Whatever the courts have in their system is what your father needs to deal with. I can't seem to find 6700vc in my bail book. What was the description of the violation written on the citation?
Re: Ticket and Courtesy Notice Discrepancy in California
Here is 6700
6700. (a) Except as provided in Section 6700.2, the owner of any vehicle of a type otherwise subject to registration under this code, other than a commercial vehicle registered in a foreign jurisdiction, may operate the vehicle in this state until gainful employment is accepted in this state or until residency is established in this state, whichever occurs first, if the vehicle displays valid license plates and has a valid registration issued to the owner, and the owner was a resident of that state at the time of issuance. Application to register the vehicle shall be made within 20 days after gainful employment is accepted in this state or residency is established in this state.
So, until he receives an amendment, I'll go with what the court has in their system and currently, the court only has
22349(a)
4000(a)
in their system. 4000(a) is a correctable offense.
4000. (a) (1) No person shall drive, move, or leave standing upon a highway, or in an offstreet public parking facility, any motor vehicle, trailer, semitrailer, pole or pipe dolly, or logging dolly, unless it is registered and the appropriate fees have been paid under this code or registered under the permanent trailer identification program, except that an off-highway motor vehicle which displays an identification plate or device issued by the department pursuant to Section 38010 may be driven, moved, or left standing in an offstreet public parking facility without being registered or paying registration fees.
Thanks for your help.
Re: Ticket and Courtesy Notice Discrepancy in California
The registration violation can be a correctable violation, but it is sometimes not. Look at the citation carefully. On the left side where he wrote the violation number, you'll see 2 rows where it says violation correctable and 2 sets of check boxes (yes and no). If he checked no, it is not correctable and the full fine is required (currently about $200). Make sure you look carefully so you don't get any suprises.

Already looked. It was marked as correctable.
