Help For A Minor
My brother will be sixteen in two months. His grandparents currently have custody of him. Our mother died last year and our father lives in Georgia. He wants to become emancipated. There are some issues of his grandparents taking money from a trust fund and also selling property that was left to him. They're basically robbing him blind. What are the odds of him becoming emancipated in Virginia at age 16? He's not supposed to have access to his trust until 18. Could this be reversed if he was emancipated? If so, he would be able to suport himself. He would come live with me (I'm 24) and I would support him, but technically with the trust he could do it on his own. My father would also agree to this, but being that he doesn't have custody would that even matter? Also, there's probably a better place to ask this question, but if he owns 50% of a house and his legal guardians have the other 50%, can they sell the house? He said they typed up a paper and he signed it giving them his half of the house. Would that stand up in court being he's only 15? He doesn't understand what he signed. Does any of this matter or will he have to wait until he's 18 and broke to do anything? Thanks!

A: No.
If he cannot support himself, then that means he cannot support himself.
Thus...he cannot be emancipated.

How did this guardianship come into existence? Why doesn't your father have custody? Who created the trust? Who are the trustees? Why aren't they exercising oversight?
