    Help With Refund Fraud in Georgia
    my brother has recently been banned from a small retail store after quitting three weeks prior with a notice. he finally admitted to me that he had returned some items without returning them w/o a reciept into cash. however it has been 40 days roughly and he has not heard a single thing in the way of a phone call or letter or anything. the amount was about 500 or 600 dollars and was told that it had been turned over to lp. we still have not heard anything. any chance he got away with this?

    No one can say for sure. Often times these investigations take some time.

    well only the manager told him he was banned and that lp would be informed. he was never caught "red handed" and the only evidence apparently is the transaction itself. but this was his 1st offense and he worked at the place 2 yrs. oh and he is 19 by the way.

    They have a year to file criminal charges against you.

    is it true that it is very difficult to file charges unless there is direct observation or recovery on property?

    Circumstantial evidence is the best.

    Most would argue that direct evidence is best, with circumstantial evidence being sufficient.

    Via the mail or phone OR Sheriff Deputies might just roll up to your house with a warrant for your arrest.

    but has anybody heard of just this going away because he has not heard a single thing at all in the way of a phone call or anything. hes not even sure if it was turned over to lp. the manager just banned him from the store

    Is it possible that they aren't prosecuting him? That's possible. Or it could be taking a while to get charges authorized. One of the consequences of getting caught stealing is that you can lose your peace of mind for a while.

    Even if we said yes that would not mean this case would have that same result

    Anytime one is convicted of theft jail is possible

    No one hear knows the details of the case the total dollar value or even the other side its not possible to guess and it would be unfair to try. we could say he would get 30 days then get one year! What good would that do. First offence theft under $500.00 normally carry no jail time but thats not an absolute! No one hear can read a judges mind! Some states carry mandatory sentences for certain crimes as well
