Assault and Battery Charge after More than a Decade
I have a 24 year old daughter from a previous marrige that ended about 22 years ago, recently her father droped into town to visit her and her children, (his grandchildren). While visiting he decided he would spend the night if it was ok with my daughter, which he has done in the past before. . However during this visit my daughter's dad, became very angry with her because he is had gave her money and ask her to go puchase a drug for him, my daughter had no idea she says on where to get this drug and even if she had she said she wasnt gonna do it, so she left the house (her house) for a little while, and when she returned she told her daddy that she didnt know where to find what he wanted and gave him his money back. Her daddy in a violent and angry manner then started beating her he broke a fishing pool across her back, he broke a cloths hanger by beating her about her whole body. My daughter did not have to seek medical attention, however she was very badly bruised and still is in various places about her body. However when the police responding to her house, seen the marks on my daughter, but believed her daddy when he said he was just trying to talk to her about coming in late etc. Im talking about my 24 year old daughter who lives alone, with her 2 small children on my land and in the home that I purchased and moved her into. I'am very angry with the law and have vowed to keep close tabs on this whole matter mainly because of my childs safety, from a man that I divorced many years ago on crimnal domestic abuse..........I can not believe that he was not taken into custody at the very moment that the police arrived, I thought that the state of South Carolina that on any kind of abuse seen that someone had to go to jail. I'am a dispatcher for a police dept. and have been for many years, In talking to the police officers that I come in contact with none seem to understand this at all. Just as I dont. I have since did a follow up with my local Sheriff, who has since allowed my daughter to sign a warrant on her daddy, after getting his officer to do a report which was never taken at first. Should my daughter had been the one to have signed this warrant? Why couldnt they just do it.? Are could they? I was told the warrant would be for assault & battery high and aggervated nature. Well to my surprise again. the warrant ended up being simple assault. Again I contacted the sheriff, and the warrant has now been changed or at least thats what they say in a letter that my daughter received in the mail. changed to assault and battery. I'am speaking of a man who is well known to the whole town as violent dangerous and etc. a man that no longer resides in the same town but pops in about 2 times a year making trouble, and leaving. I have a concern for my daughter my grandchildren as well as myself due to many on going threats over many many years. Can someone please tell me what Im to do are try next. Help and Thanks

    Criminal Prosecution
From what you have said, the initial officers at the scene acted deplorably. However, with a criminal prosecution now underway, it isn't clear what more you need to do at the moment. What more do you wish to achieve?
