Unregistered Cars Parked in Driveway in Boston
My question involves landlord-tenant law in the State of: Massachusetts
I currently have tenants that have 2 unregistered cars parked in the driveway of my deceased mothers home. These tenants have historically been late with paying the rent. The home is in my name and is currently in probate. What recourse to I have to make the tenants remove their vehicles? I will be evicting them hopefully within the next 6 months and I want to do it legally.
Re: Unregistered Cars Parked in Driveway in Boston
Start by looking up your city code to see if there is an ordinance prohibiting unregistered or inoperable vehicles on private property. If there is you can give them proper written notice that their tenancy will be terminated if they don't get rid of the cars or get them registered.
The following website has links to all the statutes addressing landlord-tenant relationships. Study up.

I'm a little confused about the situation. You say this is your "deceased mothers [sic] home," but then you say that the home is in your name and also say that the home is in probate. Assuming this is a home your mother owned before she died, if it's now in your name, then why is it "currently in probate"?
Also, assuming these tenants are renting the home, who is on the lease? You or your mother?
What does "unregistered" mean? I could guess, but I'd rather not.

If you're the landlord and your tenants have vehicles in violation of the lease, your recourse is to give notice and, if they don't comply, file for eviction.

Then I strongly encourage you to consult with a local landlord-tenant attorney.
