    Caught Shoplifting At Sears
    i am 18 and have been caught shoplifting a $5 dollar item from sears in Stroudsburg Pa. after taking the item, i went outside thinking that i did it without being caught when two guards, one dressed in plainclothes came up behind me and asked me to turn around and empty my pockets. Then they took me back inside and started asking questions. This was my first time, and i cooperated with them, giving them the information that they wanted. After looking at my id and taking my information, one of them asked if i had an arrest warrant out for me, and although i am sure that i didn't and even told him so, he didn't believe me and called the police station. he then asked me what i thought that they said, after which i told him i don't know. Then he explained to me about reciving a civil demand or something like that in the mail in a couple of weeks, and told me that i was banned from sears, kmart, and any other part of sears holding co. for life, and asked me to sign a statement saying that he had explained to me the civil demand thing.

    Whats bothering me is that since this is my first, and with how i've been feeling lately since it happend, my last time ever doing this, will i have to just pay a fine or will i have to go to court and face jail time? I already feel hurt and torn up enough that i did it in the first place, and don't want to put my family through the pain of finding out that i did this. since the cops were called to see if i had a warrant out for my arrest, does that mean that i will be sent to court, even though the guy calling them said nothing about the shoplifting???? Please shed some light on this if you can. Thank you!

    If the Police were not called then you have no fear of court or crinimal charges. Once you pay civil Demand its over steal no more.

    If they police did not give you a ticket or tell you about a court date then you will just have to pay a fine to the company.. And even though you feel that just being sad and tore up inside is enough to punish you it really IS NOT. But if that is all you got then you got of lucky and the tore up feeling is what should stop you from doing it ever again.

    In Pennsylvania, if you're charged with shoplifting you must report to a law enforcement agency to be fingerprinted:

    § 3929. Retail theft.

    Sunsection (g)

    (g) Fingerprinting.--Prior to the commencement of trial or entry of plea of a defendant 16 years of age or older accused of the summary offense of retail theft, the issuing authority shall order the defendant to submit within five days of such order for fingerprinting by the municipal police of the jurisdiction in which the offense allegedly was committed or the State Police. Fingerprints so obtained shall be forwarded immediately to the Pennsylvania State Police for determination as to whether or not the defendant previously has been convicted of the offense of retail theft. The results of such determination shall be forwarded to the Police Department obtaining the fingerprints if such department is the prosecutor, or to the issuing authority if the prosecutor is other than a police officer. The issuing authority shall not proceed with the trial or plea in summary cases until in receipt of the determination made by the State Police. The district justice shall use the information obtained solely for the purpose of grading the offense pursuant to subsection (b).

    sorry, upon rereading this i realized i had made a typo. I am 20, not 18 and i wrote the question in the early hours of the morning, and didn't notice the mistake until now. Will me being 20 have any effect on the situation? also when i get teh civil demand, and i don't have enough to pay for it right away, is there any possible way that i can pay it off, like either on a monthly basis or per check or would i have to call the offices and find that out when i get the demand? thanks again.

    Yes most Civil demand Law frims or companies will grant you payment arrangemnts however I caution you to make sure you make your payments on time.
