Hiding a Vehicle from a Title Loan Company After Default
My question involves criminal law for the state of: Minnesota

My friend is in Minnesota. She got a car loan. Lost her job stopped paying insurance & stopped paying for the loan. The loan place is calling her mom to have her return the car. She's refusing to return it. The car place don't have her updated address as she's moved. She still lives in Minnesota but like 30 miles away. I don't know if she plans on turning it over or not. She's already on felony probation for a theft of a credit card 1,000. I'm scared they will charge her with theft of the car & I'm sure that's a felony. I am currently in Arizona. I'm going to try to knock some sense into her before she gets into some serious trouble. What are your opinions on this subject. I don't know allot about this subject that's y I'm asking here.

I'm not sure if she's the signer or the co signer. I don't think it matters. Her bf is one of the people that did the signing as well.

Not my area of expertise. I do know that in the 1980s we had a company car assigned to our TX facility. This was a leased car that we did not own. The Office Manager gave the car to his girl friend, who shortly after broke up with him and moved out of state, keeping the car. A year later we closed that office, terminated everyone and asked the Office Manager for the car back. He eventually came clean. Interesting, since he had been sending mileage logs in the whole time. We called the leasing company, who reported the car as stolen. Girl friend and new husband were arrested in Canada by the Mounties. I never found out what happened to them. Nothing good I suspect.

Something bad is going to happen to your friend. Do not be there when it happens.

    Better show her this:

    Quote:

MN Statute 609.62 DEFEATING SECURITY ON PERSONALTY.
    Subdivision 1.Definition.
In this section "security interest" means an interest in property which secures payment or other performance of an obligation.
    Subdivision 2.Acts constituting.
Whoever, with intent to defraud, does any of the following may be sentenced to imprisonment for not more than three years or to payment of a fine of not more than $6,000, or both:
    (1) conceals, removes, or transfers any personal property in which the actor knows that another has a security interest; or
    (2) being an obligor and knowing the location of the property refuses to disclose the same to an obligee entitled to possession thereof.
    https://www.revisor.mn.gov/statutes/cite/609.62

She's violating her probation by committing a crime.

She needs to turn in the car or she'll be in prison (on both charges) where she won't need one.

How long do u expect the repossesion guy to come find the car? Or when can they press charges? I think it's already been at least a month she's avoiding them.

    No way to predict.

But just suppose that the repo guy does a background check for skip tracing and find out she's on probation, then reports to her probation officer that she's hiding the car. She gets violated, picked up, put in jail for the probation violation while the charges for the repo violation are pending.

Delay does not make this go away. The longer she waits to turn over the car, the better her chances are of a prison sentence. Is she really that stupid?

Stupid is like a muscle. The longer and hard you work it, the stronger it gets.
