Company Refuses Refund of a Digital Product Within the 30 Day Refund Period
My question involves a consumer law issue in the State of: International Law

Three weeks ago signed up for an online course. I agreed to pay the price of the course in ten single monthy installements, but now I have come to the conclusion that the course is not something that I want to have anymore and I would like a refund.

They refused to give me the refund, claiming that they don't give out refunds if it has been more than 48 hours after purchase, or if the the payment plan agreed to was the 10 installement monthly plan, claiming that I can't back out of the debt I agreed to.

Aren't they obligated by law to give refund or cancel the payments, by the request of the consumer,
in the 30 day window after the digital product has been purchased?

Is this worth filing a complaint to get my money back, or is there no chance?

    Thanks

How much money are we talking about? Does it say on their website that you can get a refund within 30 days?

Here's the copy of the website:

    Products

You are eligible to get a refund for courses or digital products that reference a money-back guarantee or refund on the sales page of the product. If the product is eligible for a refund, you can get your money back within 30 calendar days after your purchase. In that case, send an email to support@email.com within 30 days after purchasing the product and we will initiate a refund to your bank or PayPal account. You will receive the money within a few days or weeks after the refund is issued, depending on your card issuer’s policies and processing times.

    Program Name

If you paid the entire tuition fee upfront you can get a full refund within 48 hours after placing your order. If you signed up for the monthly installment plan, you can request a refund of your first payment within 48 hours after enrolling in the class and we will cancel all remaining installments. In order to get a full refund or cancel your payment plan, send an email to support@email.com within 48 hours after placing your order.

Since this is an interactive online program with an active Facebook group, ongoing support and other services, you can’t get a refund for your purchase or cancel the recurring monthly installment payments if it’s been longer than 48 hours after placing your your order.

All remaining installment payments have to be paid and past payments are non-refundable.

    Subscriptions & Payment Plans

We do not offer refunds for any of our payment plans.

What is a payment plan or installments?

A payment plan is a detailed plan for paying any outstanding debts. By buying a product or service with one of our payment plans, you agree to pay back a certain amount of money each month to repay the debt. These monthly payments are called installments and are non-refundable and can’t be canceled. While subscriptions can be canceled anytime before the next billing cycle occurs, installments are to be continued until the outstanding debt is fully paid.

If you wish to pay the outstanding debt with a single payment, please contact support@email.com. In that case you can pay off the remaining balance with one single payment and we will cancel your payment plan and installments.

About the money, it's 10 monthly installements of 95$.

Can they offer a 48 hours refund policy? Aren't obliged to offer the 30 day?

Let's start by getting some basic information. You said that this involves "international law." Well, international law is basically the law of how countries deal with each other. It's not something that deals with consumer rights to cancel contracts. That instead depends on the laws of the country you are in and, if different, the laws of the country where this company is located. In the U.S. it's important to know the states that you and/or the company are located. So where are you and where is this company located?

If U.S. law applies, then you are likely out of luck here because few, if any, states give you right to a 30 day right to cancel this kind of contract.

I'm in Europe, most precisely, in a country that belongs to the European Union (and it's not the U.K).

In the facebook page, it says the person (company) currently lives in Orlando, Florida.

Under Florida law there is no right to cancel a digital download or online class contract after you enter into it other than whatever the contract itself provides. If EU law might apply (and that will depend on the extent to which the company solicits and does business in the EU) then you have a right under EU law to cancel online orders for digital goods within 14 days if you haven't started downloading/streaming it yet. The link I provided gives you the details on that.

Your facts imply that it had been 3 weeks before you asked to cancel. If that's the case then even under the EU law you were too late in asking to cancel the sale. You don't say if you tried out the service before deciding to cancel, but if you did then even if your request was within 14 days you'd still apparently not have the right to cancel according to that summary of the law provided by the EU.
