Theft of Funds from a Business
My question involves business law in the state of: Alabama

    Sorry, my question didn't post....
I have a close friend who has been a private practice psychologist for more than 40 years. She has been subject to theft of funds by an office manager in the area of $150,000. I can provide details. She faces the potential loss of her practice and her home. She has no funds left to hire an attorney and the prosecutor seems to be letting much of the issue slide due to the doctor's lack of knowledge. She's been told they will peruse 1 charge of theft of property and nothing more. The office manager used business credit cards, opened new accounts (ID theft), and paid herself additional salary (without proper withholdings), all out of the office account. Is there any where the doctor can turn for help? She has literally helped thousands of people as well as crisis management for several state agencies in Alabama and the gulf area.

The first thing she needs to do is check her business insurance policy and see if there is a crime policy.

I don't really understand what you mean by the doctor's "lack of knowledge." Could you expand on that?

She should also contact a lawyer to look at civil action against the employee.

As a practical matter, I'm not sure what you're asking.

On the civil side of things, your friend needs to hire a lawyer.

On the criminal side of things, all your friend can do is report what happened to the police, which apparently has already been done. It's up to the police and prosecutor to decide the extent to which the matter will be investigated and/or prosecuted.

Thank you for your reply. I guess I'm just a bit baffled at the idea nothing will happen as a result of over $150k taken from this woman and there seems to be nothing she can do about it if the prosecutor opts for a plea deal just to get the case off their books. I would think ID theft is a serious enough issue to get federal LE involved.
    Appreciate your time.

Federal jurisdiction is limited, and the "seriousness" of the alleged crime has nothing to do with it (it seems to be a fairly common myth -- one that has given rise to a common colloquialism -- that "federal case" means "really serious"). You'd probably agree that there's no crime more serious than murder, but most murders are not subject to federal jurisdiction. Nothing you posted suggests that there would be federal jurisdiction here, but your friend is certainly free to contact the nearest FBI office to see if she can get an agent interested.
