    Receiving Explicit Pictures from a Minor
    My question involves juvenile law in the State of: California
    So I had an online boyfriend who was 19 and I’m 16. I sent him explicit pictures but he did not save them to his phone or anything. But, he was caught because of probation and he was originally not allowed on his phone. I think that the police are now investigating his phone. We sent explicit messages to each other but not that many on text. Since I am a minor, can I expect any fines or anything? I have really bad anxiety so a fast response would be nice. Thank you

    Carl, cdwjawa, may be along, he is former police officer in CA, and current college instructor, he knows CA law better than anyone here.

    YOU will not be fined or punished in any way. Your adult "online boyfriend" might but you won't.

    Could the fact that she sent explicit pictures be problematic for her? Just because they weren't saved to his phone doesn't mean they aren't still in message history. I vaguely remember reading a post about something similar and it potentially being considered child pornography.

    If they find the explicit texts or your pictures, he can be charged with a number of things. You aren't off the hook because sending them is also a chargeable offense (PC 311.2). Get off the internet and interact with real boys your age. For all you know this guy isn't even really 19....

    Not that I think the minor will actually be charged but she could be under Federal law as well as state law if the image she created and distriuted rises to the level of child port..

    Explicit messages are not generally a legal issue, but you sending images of yourself to him could, potentially, result in criminal charges to one or both of you given the right circumstances. However, the chances of you being charged are slim - assuming that your characterization here is correct. You shouldn't have much to worry about.

    Your "online boyfriend", on the other hand, may well have issues. But, he's really not your "boyfriend" if you only know him online. It's also possible that his claims of Probation and problems are bogus.

    You should be fine. Just remember two things: Online relationships are dangerous, and, NEVER send naked images of yourself to anyone!!

    Since you apparently distributed child pornography by way of your phone, the potential for criminal prosecution exists. I suggest you speak with your parents about this ASAP for the purpose of them obtaining legal counsel for you.

    Also, since all you know is what he TOLD you, you have no idea if he saved those pictures or not. For all you know, all his buddies (and their friends and their friends) now have your naked pictures.
