Is an Arrest Warrant Invalid if Your Birthdate is Wrong
My question involves criminal law for the state of : Arizona.

My friend has a warrant. If u go to mcso warrant search it will pull her up. Her date of birth is wrong on the warrant but everything else is right.

Is the warrant still valid? The warrant is from past charges. Like 2006. I was thinking back in 2006 maybe she gave them the wrong date of birth to give her self an alias maybe. I don't know. Don't tell me to send her to the police station she won't go. Lol she don't think it's a legit warrant.

The error in the birth date does not invalidate the warrant.

That's what I thought I just wasn't 100% sure. Would having a warrant would a landlord find it if they ran a credit report and criminal history check would they find the warrant?

It all depends what sort of criminal records checks they use. As you have seen, it is available so if a landlord used a source thst accessed those records, then they would find them.

Misnomers/clerical errors/harmless errors, are most generally not grounds for dismissal of a charge.

    Re: Warrants
I have seen arrest warrants tossed for incorrect birthdates. Out here, that could well be a problem and I have seen these returned to the issuing agency for an update. I suspect it could be a problem in Arizona as well. The problem is that a person can still be taken into custody on the warrant and the birthdate issue can effectively be moot insofar as the arrest goes. Even if the warrant has to be returned and be reissued, the underlying charges do not go away.
