    Can Your Ex- Take a Car if You Made the Down Payment and Loan Payments
    My question involves a consumer law issue in the State of: California.
    I thought my ex was doing me a favor when he helped me get a car. I put the down payment, I've made payments I am a cosigner on the vehicle and the insurance is under my name. Recently he took the car and refuses to give it back. I know he can not afford the payments he can barely afford his own bills. Do I have any rights, is there anything i can legally do sue him for the money I've put in. Anything?

    How is the car titled? specifically if your name and your ex’s name are both on the title, is there an and or an or betweeen the names?

    Since you said you're a "cosigner," I'm guessing that means your "ex" is the borrower and also either the sole owner on title or a joint owner. If that's right, then he has at least as much right as you do (and, if he is the sole owner, he has more right) to possess the car.

    What does your written contract with your "ex" relating to ownership and possession of the vehicle say about this?

    Many people use the term co-signer when they are referring to being a co-borrower.

    Until the op answers the questions regarding his title is held this issue is pretty much dead in the water.
