Getting Consent To Adoption From Parent Incarcerated In Another State
In Illinois the law requires the paternal parent to be in the presence of a judge to sign the termination of paternity consent. However that said person is in prision in Virginia. Most of what I have read states that an adoption by a stepparent is easier with consent. So is there a procedure or should I terminate the parental rights as the parent is unfit. And if so can this all be done at the adoption hearing?

What law or statute makes the parent's appearance mandatory? (I looked, I didn't see it, but I might have missed it.)

This is what I was told by a lawyer in my town. The consent must be signed in front of a judge.

Ask the lawyer for a cite to a law that says that a consent must be signed in front of a judge when the party is in prison in another state.

yeah, got that. Do I send the consent to the prision, who does he sign it in front of. Warden? Notary??
