    Changing a Child's Name in Texas
    My wife had two children before we were married, (and we have one together) but she was never married to their dad. He has not seen them or tried to contact them in over 10 years nor do we know how to contact him. I want them to have my last name and so does she. What do we need to do? Hopefully there is a very inexpensive way to do this. We live in Texas.

    No, this has never seen a court, nor has he ever paid any child support.

    You can petition for a name change with the county court. The putative (presumed) father would be entitled to notice, but you should be able to achieve that through postings, publication, or similar means as directed by the court if he cannot be located.
