    What to Do if You're Arrested for Petit Larceny, First Time Offense, No Record
    My question involves criminal law for the state of: NY

    Someone I know was arrested Sunday for petit larceny at Kohls. The LP told her if she signed a confession he'd let her go. Within 10 minutes cops were there to arrest her. She's 26 and this is her first criminal offense, ever!!!!! What should she do?!!! She has court this upcoming Thursday.

    Plead not guilty and see if they can get an acd / diversion. It dismisses and seals the record if they stay out of trouble for six month. A lawyer can increase her odds of getting this,also a reduction to disorderly conduct which is a non criminal offense in new york. The acd is the better outcome.

    It IS a criminal offense in New York. It is a Penal Law violation.

    It is not a CRIME but it is most certainly a criminal offense.

    It's more likely it's simply the first time she's been caught.
