Emancipation Help

I am seventeen years old, and will be eighteen this up and coming December. I hold a steady and full time job. I had been living with my boyfriend's family in Chicago since I was 15 (held a job the entire duration there except for a couple months), and just recently moved back to Florida (where I am still a resident) for cheap school. I acquired my GED last year, and just finished (I do not plan on returning, at least for a year or two) a semester of community college. I do live with my parents at the moment (who have both agreed to allow me an emancipation), but provide my own food, clothing and everything else imaginable-I had been doing most of this since I moved. I have just been confronted with paying rent, and am more than willing to pay it until I leave. I need the emancipation to be able to have a checking account, so life is easier for me when I move back out, hopefully fully on my own. I am wondering what sort of "evidence" and information I need to get together and present. I am also wondering if I need to pay for a lawyer, what I will have to do and how long this approximately takes. I have happily agreed to pay for the entire process, but am curious as to how much this usually costs. I am grateful for any information. Your parent must file the petition. Have them go to courthouse and request paperwork

Figured as much. I was trying to gather as much information as possible, so my mother and father would know what all was necessary. I realize this will be an ordeal and am unsure whether or not it is worth it to endure such a process, or wait out the eight months until I am actually eighteen. My purpose for the emancipation is solely based on the monetary benefits I am not privileged to as of now; for instance, a checking account (I have to pay my cell phone bill with a pay-as-you-go refillable debit card, and it is royally inconveniant) I am planning on moving back to Chicago with the same boyfriend mentioned to live in an apartment he is signing the lease on. I suppose I should wait, which is fine. I was only trying to look at my options to establish what I will be doing in the near future. Preferably, I would love to be out of here as soon as possible, but will stay if the emancipation, for my own financial stability, is not a realistic option.

Quoting Florida Statutes, Section 743.015 - Disabilities of nonage; removal.

(1) A circuit court has jurisdiction to remove the disabilities of nonage of a minor age 16 or older residing in this state upon a petition filed by the minor's natural or legal guardian or, if there is none, by a guardian ad litem.

(2) The petition shall contain the following information:
(a) The name, address, residence, and date of birth of the minor.

(b) The name, address, and current location of each of the minor's parents, if known.

(c) The name, date of birth, custody, and location of any children born to the minor.

(d) A statement of the minor's character, habits, education, income, and mental capacity for business, and an explanation of how the needs of the minor with respect to food, shelter, clothing, medical care, and other necessities will be met.

(e) Whether the minor is a party to or the subject of a pending judicial proceeding in this state or any other jurisdiction, or the subject of a judicial order of any description issued in connection with such pending judicial proceeding.

(f) A statement of the reason why the court should remove the disabilities of nonage.
(3) If the petition is filed by the natural or legal guardian, the court must appoint an attorney ad litem for the minor child, and the minor child shall be brought before the court to determine if the interest of the minor will be fully protected by the removal of disabilities of nonage. The attorney ad litem shall represent the child in all related proceedings.

(4) If the petition is filed by the guardian ad litem or next friend, service of process must be perfected on the natural parents.

(5) If both parents are not jointly petitioning the court for the removal of the disabilities of nonage of the minor, service of process must be made upon the nonpetitioning parent. Constructive service of process may be used, provided the petitioning parent makes an actual, diligent search to discover the location of, and provide notice to, the nonpetitioning parent.

(6) The court shall consider the petition and receive such evidence as it deems necessary to rule on the petition. If the court determines that removal of the disabilities of nonage is in the minor's best interest, it shall enter an order to that effect. An order removing the disabilities of nonage shall have the effect of giving the minor the status of an adult for purposes of all criminal and civil laws of the state, and shall authorize the minor thereafter to exercise all of the rights and responsibilities of persons who are 18 years of age or older.

(7) The court shall consider the petition and, if satisfied that the removal of the disabilities is in the minor's best interest, shall remove the disabilities of nonage; and shall authorize the minor to perform all acts that the minor could do if he or she were 18 years of age.

(8) The judgment shall be recorded in the county in which the minor resides, and a certified copy shall be received as evidence of the removal of disabilities of nonage for all matters in all courts.

Thus, the emancipation petition would have to be initiated by your parents.

Well, I guess that does it, cut and dry. Thank you for that information.

Also, I read somewhere that emancipated minors are eligible for a certain degree government aid (money, health insurance, etc.). I am unsure of whether or not this is true or not, and am wondering if you have available a link to a place I could read more about this- or, if you might possibly know anything about the matter. I doubt I will actually need the government aid. I imagine I will be without medical insurance, so aid in that department would be appreciated. I suppose it wouldn't matter anyway, I would only be an emancipated minor for few months under a year. I was curious of any additional gain I could get out of the matter.

I am aware of any money insurance etc but the purpose behind emacipation is for one to be self supporting if Government is giving you money your not self supporting

Totally understood. That is the point of an emancipation, and I never said or assumed otherwise. I was only interested in inquiring about whether or not there were ways to obtain extra money (if available, who wouldn't be interested in extra money?). I will have food, clothing, shelter and a vocation as I said in posts prior to this one. I am not going to lie and say I will be living "comfortably", only comfortably enough. I will still be struggling with money as I have for the majority of my life, even whilst away from my family. I am fairly certain my financial struggles will be close to the same for me at 18, anyway. Let me just say that for me to live on the brink of comfortability will be the same, but most likely slightly better than the financial status at my parents' home as of now.

Three other siblings, all under the age of fifteen and two parents. Only one of which works part time, and makes under two hundred bucks a week that has to pay bills- most of which my poor grandmother reluctantly covers. The welfare check only pays for two of the four children (including myself)- as when I moved out years ago, I was removed (I am also not covered by Medicaid, so I already do not have health insurance at the moment). Another younger sibling moved in with family elsewhere, removing her from the welfare as well. Among other things, this is what alcohol does to families. I help out as much as I can and am willing to...but am just looking to make things easier. If an emancipation won't do this, so be it and I am fine. If so, great.

Not abused, get along relatively great with both parents, and have no other reasons for the emancipation. Financially speaking, they're poor, I'm poor, and I'd like to be in a situation where I could be poor all by myself and try to, eventually, end up not poor.
