    How to Get a Child Neglect Finding Removed From Your Record
    My question involves child abuse or neglect in the State of: washington

    A few years back myself my now ex husbnd and my kids went camping. My kids were 5, 9 and 11 1\2. I told them not to go too far into the water. Not to go above mid thigh due to it dropping off out in the water. I went back to the camp site and my youngest ran up n yelled that my 9 year old son was drowning so I took off running. A man on a boat pulled him from the water. My son had decided to not follow my instruction n with his floaty noodle went out far. The cps worker who was called in, told me i was a good mom who made a mistake by not supervising my kids. He was not (and did not) take my kids nor was i charged with anything. Case closed. However neglect is on my record!! Cant get certain jobs.. Im angry and want this taken off. What do i do, where do i start?

    Are you sure that its on your record? Generally a closed case like that does not result in any "record".

    Washington State has two avenues for recourse following a finding of neglect. The first is to challenge the finding within thirty days of notification that the finding has been made. (Washington Rev. Code, Sec. 26.44.125). As these events took place several years ago, that option is no longer available.

    There is a provision for automatic expunction of certain records. (Washington Rev. Code, Sec. 26.44.031). Your eligibility for that relief will depend upon how much time has passed since the incident, and the exact finding by the investigating agency. It sounds like your investigation may have resulted in a finding of neglect, even though no action was deemed necessary, such that you would not be eligible for automatic expunction, but you will need to verify the exact nature of the finding.

    Outside of those two statutes, case law suggests that you do not have a means of challenging a finding of neglect or a record of that finding as maintained by child protective services.

    where was your ex-husband?

    This is one of my mom pet peeves -- parents who don't understand the danger of bodies of water and children being by themselves. No matter how well behaved the children are or whether they listen or not. I am glad for you that you didn't lose a child and that they felt it was an honest mistake.... (I was also the Director of HR for a property management company where a small toddler drowned in a pool on one of our properties)

    If you are refused a job because of a criminal background check that was run by a background provider (as opposed to the employer contacting the local courts) you are entitled by law to a copy of the report.

    That said, in almost 20 years of pulling background checks I've never seen mention of a case where charges weren't filled and the police wee not involved.
