    when does it become criminal harrassment?
    the Bio Mom recently filed for an amber alert even though we have custody. She even called the mother to taunt that she was having "her son thrown in jail, ha ha". The police filed the report, listed the son as missing, even though we have physical custody, and knew that the son was with us. I thought that filing a false report was reason for criminal harrassment, yet the police refuse to do anything about it. What is our recourse? She has threatened to do this again if we don't hand the son over to her so that they can be "cool for court" for a DHS hearing? The son knows nothing of this, we have managed to keep him out of the loop, but this is becoming quite disruptive of everyone's lives. How do we stop this madness?

    I am surprised that the police were unwilling to act.

    Talk to your custody lawyer about the possibility of going back to the court which issued the custody judgment, and getting an order prohibiting her from making false police reports. If you get such an order, even if the police won't act, the custody judge may be willing to hold her in contempt of court.

    Frankly, I was surprised too. Although, I did realize that if it were a female walking in the police station, I'm sure that the response would of been different. The police told my husband that it sounded like he was "out to get her". Total gender discrimmination.

    Is there a way to get these charges pressed? A way to circumvent the police that seem to be unable to see beyond the "oh, well she's female and you're the big strong male" stereotype?

    There may be; but it may not be worth the cost and effort. I would start with the custody angle, and discuss the possibility (and wisdom) of getting charges pressed despite the initial police reaction with your custody lawyer.
