How to Get Custody After Non-Service of a Divorce Case

Okay so now shes taking me to court because Im not paying childsupport weekly. I only owe $280 in arrears. I know she will use this on her behalf on tuesday and also the domestic violence case along that Im taking her to court in our country for appeal on the foreign divorce and custody. Theres any chance that my case on Tuesday will be dismissed based on this? If she use it against me.

Case on Tuesday is about custody

It is not a trial. There is no dismissal. There is a hearing where the court listens to each party as it relates to the reason for the hearing and makes a ruling based on that.

Custody first hearing was today. I retained a lawyer and he was able to explain the situation. He explained that step mom is interfering with my communication with my son mother. The judge agreed and said communication should be between us not with an interference and that it looks like they are interfering with the communication with my son. She denied to give me her phone but she had to call me from HERS not wife phone. For now I have three days phone calls.

I heard she’s planning to use a lawyer as well as she saying that step mom is not interfering but preventing me from using my son as an excuse to communicate with her. And that I want to annulled the divorce because I want her back.

They need to understand that Im doing this for my son.

For now, will be visitation hearing instead of custody.

Any advice? It looks like things are getting on my favor now

I think that things are improving for you, but if there is any chance at all that you are insisting on communicating with her because you want contact with HER, or because you want her back, or want to punish her, then make sure that you prove her wrong by being perfectly polite and discussing nothing but your son.
