    A Few Questions On Emancipation

    hi there
    im 15 years old, coming close to 16, i have a regular 16 year old job, dont make much but i make enough. My family life is not in the best shape. I would really like to start beauty school soon beec thats what i want to do in life. My dad is all for emancipation but i had a few questions

    ive been working at my new job for about about a month, is that good?
    I know u have to give a reason of why id be better off, would the fact i want to continue onto beauty school be legitimate?
    Is it true that my grades will affect a decision?
    Is there a certain amount of money i have to make>?

    Circumstances That Are Grounds for Termination of Parental Rights Welf. & Inst. Code §§ 361; 361.5; 366.26

    • The parent has abandoned the child.

    • The parent is unable to discharge his or her parental duties due to:
    o Mental disability
    o Extensive, abusive, and chronic use of alcohol or drugs
    o Incarceration or institutionalization

    • The parent has physically or sexually abused the child.

    • The parent’s conduct or neglect has resulted in serious physical injury to the child.

    • The parent has refused reunification services.

    • The parent has been convicted of a violent felony, indicating parental unfitness.

    • The child has been left without any provision for his or her support.

    • The parent has failed to visit or contact the child for 6 months.

    • The whereabouts of the parent have been unknown for 6 months.

    • Parental rights to another child of the parent have been involuntarily terminated.

    • The parent has caused the death of another child through abuse or neglect.

    • The parent has subjected the child to severe or repeated sexual or physical abuse.

    • The child was conceived as a result of a sexual offense against a child.

    • The parent willfully abandoned the child, and the abandonment itself constituted a serious danger to the child.

    According to the California Courts,

    2. Join the armed forces. You need permission from your parents, and the armed forces must accept you.

    3. Get a declaration of emancipation from a judge. To get a declaration of emancipation, you have to prove ALL of these things:
    • You are at least 14 years old.
    • You don't want to live with your parents. Your parents don't mind if you move out.
    • You can handle your own money.
    • You have a legal way to make money.
    • Emancipation would be good for you.

    As part of the emancipation process you must:

    Write a statement to the court that explains:
    • How you live,
    • Why you want to be emancipated,
    • How you support yourself, and
    • If you have children, how you support them.
    • If you don't know where your parents or guardians live, tell the court when you last saw your parents and what you've done to find them.

    If don't want to tell your parents about the petition, tell the court ALL your reasons. You can ask the court for permission to not tell them.

    Attach letters from your boss and your landlord if you want.

    Why would you be better off being emancipated?

    Why not attend beauty school while still being a dependent of your parents?

    becuase they dont want me at home, school is too far for them to take me and i have a place to stay wtih a family frriend near the school

    they wont i already tried, they dont want to be responsible for my actions

    so i cant get emancipated even if i have a job, a place to stay, and a valid reason to be emancipated>?

    You have to qualify for emancipation. Read the materials I posted and explain (here or to yourself) how you qualify. If you believe you qualify, nothing is stopping you from filing a petition with your local court.
