    About a year ago my teenage daughters accuse my husband I'm now divorcing of molestation I have three other children by this man and when they accused him I placed temporary custody with her father who was supposed to have supervised visitation but under the circumstances I felt it was necessary the same day my grandma died and I moved to Indiana with three other children my husband was arrested and sent to jail .

    Since then my first husband has refused to give the girls back was originally supposed to pay me child support but I gave them my house so the girls would have a place to live instead of living with his mom . So he ended up with my child support card he owed me $40,000 in back child support because he refused to pay for six years now or year later when I found out that he had the child support card I canceled the monthly payments because he had the girls and I had no money to go get them or take him back to court to remove them from him to get them back in my physical custody I had a new card sent to me he still owes me that back child support he makes $4000 a month and I make 1500 a month

    I'm a single mother of three and he's married with only one other child other than our two he threatens to file for child support against me if I took the backpay away from him . I'm on food stamps and Medicaid to the government for me and my three children he's not any he's not on any government assistance at all what am I obligated to pay . And what do I do about the fact that he refuses to give them back when I have full custody and won't even let me see them for a visit or anything . And at this point my 15-year-old says I'm dead to her and that she wants nothing to do with me and that she looks way better now than she ever did with me because he makes so much more money and can spend so much more money on them then I can .

    Your post is very hard to read. Is this correct? You left the kids with him a year ago and moved out of state. You are receiving child support payments from him for back support and he wants to get support from you. You think you shouldn't pay because he makes more money than you and you have 3 other kids and get government assistance.
    When you "placed the kids" with him, were the courts involved?

    Why did he have Supervised Visitation ? Why didn't you take your daughter with you ? She had been through a terrible experience. She needed her mother.

    If dad is still being ordered to pay child support, a court will enforce that order unless and until he obtains an order modifying support. He can receive child support from you even if he owes arrears, as the children actually do need to be supported.

    If you are receiving public assistance from agencies based upon their belief that the children are in your household, when they are not, you need to be careful that you're not doing anything that could be construed as welfare fraud. You need to make sure that you continue to qualify for the benefits you are receiving, and update your household information as required.

    If you continue to have an order for custody and your ex- won't return the children, you can petition a court to mandate their return. If your children are @15 years old and don't want to go back, under the facts you have given your ex- has a very good chance of winning a motion to modify primary physical custody from you to him.

    You need to discuss your situation more fully with a lawyer in your state.

    Just as an FYI. In many states these days child support is direct deposited to a debit card provided by the state. Hence the term "child support card".

    CSE tried to push me to do this. I opted for direct deposit. They must get a kickback or something because it seems like a bigger hassle to carry around a separate card for me, but they try to push it.

    They do it so they have the ability to batch lots of payments together.

    Ahhh. Well it's way more inconvenient for me to carry a card and keep track of a balance on a debit card when I could just have the money in my account.

    They do it because many of the recipients do not have bank accounts and therefore cannot have direct deposits. This enables the CSE to utilize the efficiency of direct deposit even when recipients don't have bank accounts. Its similar to systems used by employers for employees that do not have bank accounts.

    I get it - like the Global Cash Card kind of thing. My ex husband had to get cards like GCC or similar the few times he's had a job in the last few years because he has no bank accounts of any kind.
