    From What Point of Time Do You Have To Pay Child Support
    The father of my children left us two years ago.(WE did not know he left us until 4 month after the fact) He did not pay anything for them for about 7 Month. He started paying 400$ a month for both of them in total 13 month ago. I was just in the States to get a divorce, he just did not agree on anything or offer anything. (ESP) Now I have to fly back in June to ::: I do not know what. I am new to all of this and lost in space. All I worry about is my children (now 13 and 15). When does he have to pay child support? All I remember is Lawyer saying he is making voluntary payments. What do I have to do or what do I have to expect when I am flying back over there again and he is still saying no to everything in the hope I give up due to being out of money flying there all the time? Can please someone :confused: explain all of this a bit. Thank you so much!

    You have to pay child support from the point at which a court orders you to pay child support.

    Meaning ? I have to wait until the divorce is final? Sorry I do not understand! If so, does he have to pay money back for the children ? The time frame he did not pay anything?

    As with so many of these issues it probably varies from jurisdiction to jurisdiction but by here in my State there is a common law obligation to support your children so theoretically at least you could attempt to get it retroactive since the time he left and quit supporting them.

    Aside from that, if your divorce case is ongoing you probably could get your case set for a temporary hearing to get support started before your divorce is final and here again you may be able to get it retroactive. I just had that happen for one of my clients in a paternity action a couple of weeks ago--got support in place temporarily until the paternity action becomes finally adjudicated.

    I'd strongly suggest consulting a family law/domestic relations attorney in your area if you have not done so already.

    Thank you for your information. Does that cost money again for a temporary hearing to get support started? I have to fly in from Europe every time for these things. NJ is the place where the father of the children lives there for the divorce papers got started.

    Oh Joy, since we seem to be at the never-ending story. One last question. How many times do I have to fly over until a divorce is final? We just had the ESP, where the mediators told us from their point of few who should get what and who needs to pay what. Now since he does not agree on anything or even just throw an offer in for what he would think is fine. How long can his game cont. to go on? I would have not minded going to a retired judge (sorry I do not know the correct word) and just accept what ever he would have decided) did not go for that neither. I do not even really know what will go on next time or what I need to come fore again. If he can walk out anytime and say no to everything, it is kind of senseless flying back and forth. After all, it would be the children that have to suffer again cause I have to pay for plane tickets. Not sure if that is worth it then.
