    Can I Get Emancipated Even if My Parents Say No
    My question involves juvenile law in the State of: Oregon
    My dad is and has been my whole life, physically and verbally abusive, my mom is aswell verbally abusive. They are controlling past the point of parenting, and it is unhealthy. I have been researching emancipation for several years, and have been waiting to turn 16 which I did several months ago. I am almost completely positive that even though I have my own job, and my own money, and I would not only be able to support myself but also already have a place I can live permanently and would be able to pay rent, because of my parents controlling personalities, they would not want to give up the control and power they have over me. I have no privacy in my home, my mail is opened, my room is searched constantly, and they accuse me of things I would never do (ex. stealing from them). It is an unhealthy environment, but can will the judge approve my emancipation if my parents say no?

    Extremely unlikely. Even though Oregon doesn't strictly require parental consent, they will listen to what your parents have to say before a ruling is made. Understand that just having a job and a place to live is not sufficient. Note that the judge is going to insist that you have a high school diploma or are on a definite path to such as part of this. No public assistance will be allowed as part of the plan. You let me know what job you have that will allow you to attend school (and maintain grades) and provide for food and shelter and everything else.

    "Controlling" is what we call "good parenting." Nothing wrong with what your parents are doing.
    Alleged abuse is not grounds for emancipation. We don't emancipate the abuse, we find them alternative custody.

    If you're being abused you call the authorities or tell a trusted adult. Emancipation isn't for that.

    No privacy, opening mail and searching your room - that's all stuff parents can and are allowed to do. That's not really excessive. My parents didn't do it but I never gave them a reason to do so. People have different parenting styles.

    To qualify for emancipation in Oregon, from what I have seen, you must already live on your own. So if your parents won't let you move out it looks like a non-starter.
