L1 and L2 Visas
My brother has 33% ownership on a company incorporated overseas back in 2002. The company has not had a substantial profit each year, but it has.
What would be the best Visa he could apply for if he wishes to increase profits and widen his market?
He has current Turist Visa so for him coming to the US and incorporate would not be a problem. The issue is, what if he needs to stay more than the 180 days allowed while he establishes the whole operation? Also, he might (just might) be ineterested on applying later for a residency.
By the way, no millions available for an Investor's visa... not yet at least

He should not be doing business on a tourist visa. That's not tourism. I don't have enough information to assess if he would qualify for an L-1 visa, and he doesn't seem to want to abide by the restrictions of a B-1 visa, so I suggest that he have his situation reviewed in detail by an immigration lawyer.

It seems that you are missreading. He IS NOT doing any business on a turist visa. NOT A CHANCE. He lives overseas and has his corporation overseas, not here, not yet.
I am not saying that he is either working or coming to work on a Turist Visa. What I mean is that he can fly to the States at any given time as he has a Turist Visa, thus he might be able to COME and INCORPORATE the company
