    Is It Possible to Be Emancipated Without Parental Consent
    I am 16 years old. I live in Virginia. Is it possible to be emancipated without parental consent?

    I have a part time job and if I am emancipated it will be full time. I have a place lined up to live that I can afford. I usually make honor roll in school and I have no criminal record. My parents make a lot of money, however, they insult me a lot on my IQ and mistakes I've made in the past. They heard me talk about emancipation in the past and they immediately shut it down. In public, they act like they don't do anything wrong and I'm just a rebellious teen so I'm worried that if social services does an investigation they won't find anything that will allow me to be emancipated. What are my chances of successfully emancipating myself? Is it possible to emancipate myself without parental consent?

    No, no, and no. If you are not already living on your own with parental consent and are able to completely support yourself (that does not mean living in your best friend's spare bedroom or living with your boyfriend/girlfriend while they/their parents pay some or all of your support - it means that you are the one paying the utility bills and you are the one making the rent payments and you are the one who pays for health insurance and you are the one who buys the food and clothes and internet connection and pays the school fees and provides the transportation and the insurance) without any help from your parents (or anyone else) then in your state emancipation is a no-go.

    You don't need to worry that Social Services won't find anything to let you be emancipated. I can tell you right now, they won't. (P.S. Social Services does not emancipate minors. The court does.)

    If social services get involved and believe that you should be removed from the home, you will go to foster care. You will NOT be emancipated.

    No, it would be almost impossible for you to be emancipated without parental consent. Emancipation is for minors who are already living on their own and need to be able to sign contracts/leases etc on their own...and then only in pretty extreme cases.

    Virginia will only consider emancipation in three circumstances:

    1. The child has entered a valid marriage. Before you go there, realize that children under 18 require parental consent to marry in the Commonwealth.
    2. The child has entered military service on active duty (again, takes parental consent).
    3. The child is ALREADY (as llworking points out) living on their own with parental consent.

    The child needs to show they are fully self supporting and able to handle financial affairs. This gives the child the ability to do some things that normally would be prohibited because of age: enter into contracts, marry, convey real estate (even parents can't convey real estate owned by minors).

    Just to clarify one point above; not all age-limited restrictions are removed. You still can't smoke, drink or vote even if emancipated; you must still attend school and in many states (I don't know offhand about VA - I'll take Ron's word for the matter) an emancipated minor still cannot marry without consent.

    However, that is for purposes of clarity and for the benefit of others reading here - the OP still does not qualify for emancipation.

    Correct, sorry CBG, you are of course correct as well.

    The relief form emancipation are specfiically listed by Virginia statute: ability to form a residence, ability to marry, ability to make educational decisions, ability to enter into contracts, and ability to pruchase/convey real estate.

    Virginia is one of the better states for that. :)
