Effect Of Possible Car Repo Before Divorce

I live in Indiana and am not sure what their laws are pertaining to my situation. I plan on filing for divorce. We have a van which is all in my husband's name. I pay for the car mostly because I drive it, but other than that I have no legal attachments to it. My husband lost his job and didn't find another for about 6 months, so naturally we are behind. If we do not pay this month they will reposses the car. Will I be responsible for the debt owed on the loan if it is repossed. I am not for sure if this will be considered marital debt. I want to know would it be best for me to let this happen prior to filing or should I continue to struggle paying for a car I will not be keeping anyhow? He says they won't come get it and that if we were to divorce the judge would make me take it on...but again my name is no where on that car. I plan on buying a vehicle on my own and am not sure if I should do this ASAP.

A: If your name is not on the loan or the title, then I doubt that you will be held responsible for it, especially if you do not get it in the divorce.

A: If I were you, I would make sure that your lawyer said in the divorce papers that you wanted the car and that the judge should make your husband sign it over to you.
