    Suing Over Vandalism Of A Car
    Okay so i'll try to explain the situation, A couple months ago, about maybe 6 I was involved in a car accident that resulted in no damage to either of our vehicles. A few months later, the other party involved came knocking on my door screaming for money replacing his entire back end of his vehicle, after a long argument it ended with him attempting to sue me in small claims court, a case in which he lost.

    Anyways, in the weeks coming up to the court date my property along with all the vehicles at the house were severely vandalized, tires were slashed, shit was broken over the cars roofs, in all the damage totalled in around $7,000. :wallbang:

    Needless to say, i immediatly informed the police and he has become the main suspect in this case and i was wondering if i possibly could take sort sort of civil action against this man. A total of four residents vehicles were damaged so i was wondering if i should make it a class action lawsuit involving all four party members instead of filing four different cases.

    Any suggestions?

    The only evidence i have is testimony by my roomates because prior to all the damage happening they saw his vehicle sitting in front of the house and he came by screaming that if i didn't give him money in 24 hours i would regret it....Other then that i really have no real evidence other than what the police have gathered. Which so far i think is little to nothing.

    He hasn't made any solid confessions but through a series of arguments with the man, i can definately tell it was him. With his friends telling me to shut the **** up and take what i deserved. And while i was in court he brought it up saying sarcastically "Oh, sorry about your cars" just one of those things where you can tell they did it, but can't prove it.

    i don't think you will win without any evidence, but irregardless, it wouldn't be a class action suit. it's just you vs. defendant1, defendant2, defendant3 and defendant4

    If you don't have an eye witness that can testify that he/she seen them do it, it is a very weak case.

    Although your suspicion is probably right.... you would have the burden of proving that it was him that did it.

    Hopefully the police will come up with something that will get them charged and convicted of vandalism, then you would have enough evidence in a civil claim against him.

    Also if four other vehicles were vandalized, I'm surprised nobody seen anything.

    Actually, it would be me, my three room mates and him being the defandant.

    As for nobody seeing anything its because it all happened in one night, sometime around 4-5am. Nobody was awake at that hour.

    I would just hold/wait & see if the police come up with anything before proceeding with a civil suit. If they come up with no proof that it was him, you will have a hard time trying to prove it in court. If the police develop some proof/evidence that it was him, then you would have evidence to use in court.
